Malpractice and unfair trades adopted by non banking finance company

The vehicle was towed away in the middle of the road by the four gundas of the finance company forcibly from borrower`s driver without the prior intimation or notice to the borrower or the local police station. No norms for the recovery & repossession of the hypothecated assets were followed. The borrower had filed the complain in district Consumer forum but the consumer forum turned down the complain on the grounds that the arbitration award was passed and this court doesnot have rights to entertain the complain. The finance company did not inform the borrower about the arbitration award nor sent him any copy of this award although this award was passed in june 2014 and the vehicle was towed away on 26 november 2014. Infact the finance company has kept the borrower in total dark about this arbitration award and has still not sent the copy of the arbitration award to the borrower. The borrower also complained to the local police station as well but no action was taken. so, the borrower has filed a petition under 156(3)in local court which is still pending. The borrower has decided to challenge the order of the district forum in the state commission. Can the borrower still raise his objections against the arbitration award and challenge it on the grounds that he did not have the knowledge nor received any copy of the arbitration award passed against him and no copy of this arbitration award was sent to him by the finance company? The borrower has also complained about the malpractices and unfair trades adopted by the finance company to the Governor and requested him to terminate the license of the finance company.what are the additional legal remedies available to the borrower against the finance company?

Request for citation for setting aside the order for non issuance of summons

My father was a government employee and he passed away in January 2008 and one of his colleague had filed a money recovery case saying my father had borrowed money from him and he has a cheque to that effect and he made me, my mother and the bank party where my father was working, to withhold the benefits payable to my mother on death of my father. The Bank received the summons were as I and my mom didn't receive the summons and at that time, the court had not stopped or objected for non payment of his benefits. The Bank had asked me to get the order sheet from the court so that they release the payment. I applied for the entire set of the order sheet and submitted to the bank and the payment was released. He has forged my father's signature and has made a promissory note and also a notorised affidavit of my father saying that in failure of non payment of the loan amount his legal heirs will make the payment. I discussed the issue with the advocate, he told me that once when you receive the summons to approach him and I never received the summons and after two months I vacated the home and moved to a different place in the same city. I again check with the advocate he told me once I receive the summons, I should contact him. Hence I didn't receive any summons and recently I received an expatiate decree to release the payment, on what grounds can i file a case for recalling of the case and any citations which can help me to recall the case, please help

Agriculture land civil suit

The plaintiff filed a suit against me for possession and for specific performance on the basis of forged & false documents and interim injunction application against me in an agr land. I as defendant (true owner with title holder) filed WS etc. and also an injcn appln against him under O39 R1-2 r/w S-94 & 151 CPC. Court has dismissed plaintiff claim for injunction finding all the three ingredients against him. It also dismissed my injcn appln holding that no permanent injunction was prayed for so no interim injcn can be granted. How can I take possession of my land. Can I take police help for taking possession. I have nowhere in the suit accepted that the land is under his possession. What should I do? I also want permanent injunction against him. Kindly advise. Thanking you and kind regards. SP Verma

Daughters right in father property

Dear Experts,
As we know few weeks back SC ruled daughters whose fathers died before 2005 not eligible for equal property rights, I would like to ask one fundamental question? What if father died before 2005 and mother after 2005? does this rule still applicable even if mother died after 2005? also what are the aspects which allows shares in father property for a girl & what are the aspects which blocks shares in father property? Regards
Venkatesh

Land for telangana 2 bhk scheme

Hi,
i am resident of hyderabad, recently telangana government passed GO to make 2 bhk houses for the eligible poor families/slums.

In my area, only my house is own/registered and rest all are occupied by slum dwellers.
Now Govt. is doing survey to give houses for the residents of the slum, i am being told that along with the others even our house will be demolished and govt. will proceed with the 2bhk scheme.

I have no objection if govt. creates home for the poor people, just that they should not break my house for giving house to them.

What do i need to do as precautionary steps?

Regards
Ashwin
