I hD entered in to an agreement with the party in July 2012 and gave some loan. As per agreement he was supposed to return the money in two years ie by 2014 July and also gave cheques as guarantee for refund of money of date June 2015.
Now that all cheques are dishonoured am I eligible for filing summary suit for relief now in November 2015?
Is it in time limit and how time limits are computed in such case?

a corporate giant has filed a civil defamation suit against me my editor and ceo. i have moved an application to open a mjc on several charges of perjury against plantiff no. 2 and have plans to get the suit dismissed on the grounds that the case is not maintainable because the four news reports drubbed libel was filed in wider public intrest soon after an incident of fire . I am a working journalist associated with a english news paper. could i file the application under order 7 rule 11 of CPC seeking dismissal of the suit because law has protected us. kindly guide. i am representing the case in person.

Weather civil court stayed auction under securitization act.in case of fraud and absurdity.ie: a has 125acer agricultural land property on 8A extract but b who is bank mortgaged 137 Acer.weather it's case of fraud and absurdity.

The land is situated on the border of the Cantonment and Municipal and both parties are claiming ownership over the land, whereas the occupant has taken on lease from the Municipal the said plot of land, now the Cantonment has invoked the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 (PPE ACT) and has issue notice to vacate the land.
Is there any judgement by the SC that if the property is in dispute the PPE Act cannot be invoked or that a civil suit lies if the property is disputed.
Another query is that whether a notice is required to file a suit as per section 80 CPC when the notice to vacate the property is given by the same authority.

1) We are three brothers. We have three agriculture land . On this land ( On 7/ 12 utara) all three brothers name was available. In one of land is acquired by irrigation dept. Accordingly One brother is selling the sand from that land. hence my another brother has filed case on him (As a accused No.1)& on me (As a accused No.2).
2. In last year 30.10.2013 they have mutual agreed or settle and present the application to court regarding disclose the case and give the order(Hukumnama) accordingly what ever they settle. (In that application they have divided the land without my concerned as ex-party)(the application enclosed as Ex-57)
3. Accordingly court has mentioned that i) "the suit is disposed of as per the terms & conditions contained in Ex.57" & ii) "Costs in cause" ( document is enclosed)
my question is that whether as mentioned in sl.no. 3 it is order(Hukumnama) of court or it is closing of case?

In my sale sgreement of land it is mensioned that sale deed will be executed on or before15/1/2016 & it is unregistered The land value increasing twice in a year. I may be known that
1 . whether it is a Time is of the essence ageement ?
2. If puchaser will not come farward up to 15/1/2016
Then whether he will be treated
as ready & willing for contract ?
3. After 15/1/2016,how many time extensions I suppose to give him & for how much time periods for his will & unreadiness for saledeed .?
4.whether unregister agreement is admissible in court ?

My sister has filed a suit for declaring Will Null and Void and for eviction order against her late husbands nephews to whom the will is allegedly written by her late husband before death(2005).
But only 2 reliefs were asked
1 Declaring will null & void
2.Eviction order against current occupants
Relief was not asked for mesne profits by way of rent loss caused to her from date of death of her husband and damages, due to illegal possession of current occupants as she is only class 1 heir. Earlier, the probate obtained by them was called back by court and a fresh trial ordered by court and probate petition is also clubbed with this suit.
Can she now move an application to be attached to her main suit for this relief too, to be disposed off simultaneously with the main suit. Under what section of CPC
In civil suits, can plaintiff tender applications at various stages, if required?
2. What is specifically required to prove that Will was made under pressure by her husband's brother and his family in her absence, she being in army and always posted outside Delhi.
3.Is there any appropriate related authority from Apex court?

Is it must for the finance company to get the Execution order from the court to Execute the Arbitration award to repossess the hypothecated assets? Is the borrower summoned to appear and given a chance to defend himself by submitting his say in this Execution proceeding in the court?Relying just on this arbitration award and without approaching the court can the finance company directly repossess the hypothecated vehicle from the middle of the road ?

Father property share

Please suggest following
1. We are two sister& mother after my father passed away and due to dispute by my younger sister , i call for 1/3 share of property in dehradun
2.In suit my mother reply in honable court for that i will able to get only 1/6 as she was false say she was help my father for purchase land and construction ,but originally my father is govt servant and he taken loan from pf and sbi bank and also house is in the name of my father and my mother is house wife for long and she are uneducated
what as per u my share is 1/3 or 1/6
also second question are my father was handicapped and due to in all bank i was add joint name of my mother and sister as my mother was unfit not medically but all knows her condition
1. i calm for my 1/3 share from bank and bank reply after my father death nobody deposit my father death certificate in bank and in my father account deposit sum of my mother and sister ,make different fd by their name and after suit she collapse all fd
as per u what i will get 1/3 or 1/6
