Contracts

What is the difference between executed and executory contracts? If a contract has been fully performed by one party and not at all performed by another, under which category will it fall? If both parties have done a part and some part of performande is left to be done, then under which category will it fall? If one party is still doing and the other party has not done anything yet, then under which caregory it will fall?

Lawye refusing to give noc

Respected Sirs and Madams,

My civil case in family court is in argument stage. My lawyer is not attending the case and last two dates he didn't appeared. My next date is approaching and he is still not giving me any time to discuss despite of trying to reach him multiple times over phone and SMS.

Today I visited his office and he is saying that he is busy with other important cases and not interested in taking my case further. He is asking me for fee if I need NOC which I already paid. He has charged me in advance and for every visit he or his assistant made.

I am helpless and not able to understand what to do.I discussed with another lawyer but he needs NOC.

Please guide. What are my options if he doesn't give NOC. Can I keep another lawyer as an additional lawyer and let him do the argument? I hope that doesn't require NOC

Passport place of birth change

Hi

I applied for renewal of passport & along with that i want to correct place of birth mentioned in passport. As per new process, I need to get court order by magistrate. Now case filed & awaiting for hearing date. Now i have to apply for H1B visa from company & I need to submit relevant documents before 31st Dec 2015. But since my first hearing is on 5th jan 2016 and i will be late till that time. Is there any other alternative to process my H1B till that time?

How many parking space for 1 member

Dear Sir
I stay in Mumbai , our chairman has only 1 flat but parking his family 2 cars and that is again in others stilt parking whos owner is charitable trust who do not have any cars registered but having 2 stilt parking with 1 flat ownership . is this Legal ?

Sir is there any time period limitation for filing a summary suit u/o 37 CPC from the date of cause of action arises ?

Credit card back from 2005

Hello Everyone,
I had a credit card back from Standard Chartered in 2001 and last payment was done in 2005 and now in Dec 2015 a guy from Mumbai calls me and tells me that he is a lawyer for Standard Chartered bank and he says that I have not paid the credit card from 2005 and now I have 2 options. Options are I can comprise and pay Standard Chartered through this lawyer or else he will issue a legal notice and issue a non bailable warrant against me. I am not a lawyer and quick search on Google says that there is something called statute of limitations so please help me answer some of the questions I have?
Q1: Does statute of limitations apply to me as the last payment was done in 2005
Q2: If I ignore this lawyer, can he issue a non bailable warrant against me
What do I do?

I stay in Suberb of MUMBAI , where in June 2014 Out MC called SGM and without any Election or selection Agenda , they themself selected 4 person MC and even after that they not inform to Society members by sending MOM of SGM, is this valid

How to stay the further proceedings of the execution petition?

I am the 1st respondent in Execution petition. This case is chit fund's money suit. 2 and 3rd respondents are sureties to me. I also paid 85% amount.I also paying money till now. Benami transactions

Is that Benami ownership of sole propitiatory dealership petrol pump in eye of law if:
1) Income tax e-filed by Assessee.
2) Bank account on the name of firm and first signatory is sole proprietor of such firm.
3) Communication Letters with official of fuel corporation signed by the owner/dealer.
4) Deed of lease signed by authorized signatory.


but dealer would not been present on the pump site from the beginning of dealership.

What is consequences & penalty in above situation, if Authorized Signatory or officials of fuel corporation claimed such fuel station as "Benami".

Execution of civil decree

Can a woman be arrested in civil decree if she is unable to pay the decrial amount? She is a wife of a practising advocate and in the decision for a suit of eviction, rent and losses order is passed against her. Weather Under the Code it is permissible to arrest and detain a woman who violates an interim injunction? because she did not paid rent even after interim order since a long time and so the decree amount increased up to a tune of Rs.3,15,000/-
