Trespass during pending case

Hello, I need some clarification on recovery of trespass. There is a case pending in front of the court. Other side have encroached some of the portion by means of trespass and the same have been confirmed by the court appointed advocate commissioner. Do I need to go for recovery of encroached portion? Please clarify.

Advocate scribe appearing for benificiary

Respected experts, Please clarify my doubt. Can an advocate who prepared an unregistered will also signed as the scribe of the will under the heading 'prepared by' file caveat applications on behalf of the benificiary after the demise of the testator of the will against the other legal heirs of the testator? And he also subsequently deposed evidence on the side of benificiary supporting the benificiary in a suit filed for partition of the will mentioned properties by the other legal heirs . His evidence can be discarded since he filed the vakalath namas in favour of benificiary in the aboveasid caveat petitions anticipating litigations ? Pls carify is the advocate scribe/ benificiary wittness in the suit for partition is an interested wittness? What is the validity of his evidence? He was already an advocate of the benificiary in the caveat petitions. But later gave evidence in the suit supporting execution of the alleged will in the partition suit. Thanks

What should be choosen for starting period of limitation?

when the money sued for becomes due?(limitation period time from which it starts under article 62 of limitation act)
what is the starting of limitation period under this
wheather date of dispossion or date of knowlege should be considered for cause of action i.e limitation period

Muslim Law

My friend's Name Mahemood belonging from Muslim Community have five brothers.
Here referred B.B's father referred here A. His father executed Mrutyupatra(Will)in favour of three son and deprived 3 sons from the property. All brothers and father has cultivating land and kept in possess ion after the death of A,B's Brother apply to talathi office take mutation entry on the basis of Mrutyupatra. Talathi took mutation entry after 14 years of A's death. What I should I do?

Defects clearing-petition bearing diary number

Kerala Government filed a case against to our Association. Government won the case.we expected a appeal before the Hon'ble Supreme Court.But Government filed a defects clearing petition bearing diary number.
(1)Our doubt is -why Government filed defects clearing case instead of direct appeal (Special leave appeal petition).
(2)Why court not cleared those defects at the time of hearing.
(3)If any chance for convert diary number as appeal case number.
(4)Does any time limit for filing a defects clearing petition.
(5)If defects are not cleared with in reasonable time -what happen?
(6)I think defects clearing petition (with diary number)is unimportant case-if it is correct.
(7)I got diary number-how to get related High Court case number from Supreme Court website.

Indian stamp act, 1899

Dear All,

While stamping the document as per Section 5 of Indian Stamp Act, 1899 (with respect to Delhi), where an instrument involves distinct matters is chargeable with aggregate amount of the duties with which separate instruments, each comprising or relating to one of such matters, would be chargeable under the Stamp Act.

Now I want to know that, while stamping the instrument, which involves distinct matters and chargeable with stamp duty under three or four different Articles of Schedule of the Stamp Act, So which Article would be mentioned on the stamp or all the Articles under which stamp duty is payable will be mentioned on the stamp.

Seperation from wife

one of my freind is married 2 yrs back and have a baby now
but he is not happy with his married life so he lives apart from his wife from last 10 months.he is done customary marriage and still not registered his marriage in court.
now he want to marry a girl which he loved before marriage.so what he can do to make it simple for both .and issue occurred when he do this

Land disputes

In 1995 my grandma makes a will for her 1acre land in favor of her 2 sons and her 2 sons, each had registered gift deed of 50 cents in 1995 itself...Now the elder son(my father) had gifted me through registered gift deed his property of 50 cents in 2014. The property has been mutated to my name and am paying taxes too.
In 2015 i put a fence in the said property. BUT my fathers brother/grandmas younger son has filled a CIVIL suit against me/my father mentioning:

1. We have encroached his boundary & seeks stay.

2. He further states: Out of the total 1 acre from my grandmas will...my father took 50cents and he is having only 20 cents!(LAND WAS LESS WHEN MEASURED)
He is saying that there is no 1acre instead only 70 cents and he wants to divide that equally NOW.

What maybe the legal outcome of the suit filed against us?
