Greedy brother want to sell and grab the front portion of the commercial property

temporary injunction

We have a joint property in our father name, my father died interstate (without any will). My elder brother is not honest in his approach. He wanted to grab this land and might be sell to someone else.

So what is the procedure so that the land gets transfer in our name?

Front property is comercial and back property is resedential he wanted to take the property of front. Back property is 1/4 times the front property. I am living in noida and he is living in the town where are property is situated.

I have heard scary story of the property that he can seel the front property to someone else and he will not give you any road. Back property will be completely isolated without any road from the main road.

So Can I saved my right so that he will not sell the land?

I have heard two things one is partition suits and another is temporary injuction...


In partition sutits we have to give the stamp duty according to your share.

How to save my rights?

Any help would be helpul.

My father took a house in a cooperative society in name of his mother in 1972 n she dead in 1978 but filled all installments by my father only till 2008 we have the reciept also. Now other relative asking for share which my father not welling to give. Please tell how to claim ownership right of father.

Gods land dispute in family members

Dear LCI,

Property - god land (devudu manyam in TELUGU) belongs to 10 families in Andhra Pradesh

Out of that 2 family members from the same group sold some property and still trying to sell remaining property without telling ot other families.

Now, in this remaining families one family there is a practising advocate of 2 years experience who is intersted to place an advt (PUBLIC NOTICe) to stop the above said 2 families wrong doing things.

However, the remaining families (7) are not ready to pay money for the advt, but they are saying that they will support this advocate

QUESTION
As an advocate he can deal with cases (place an advt i.e public notice) on interest of his own

Doesnt he need any permission/affidavit from the remaining families to place an advt (public notice)

Without doing so, can he straight away act as a ADVOCATE on behalf of others(client) for giving a public notice

Sir in a petition being filed by me for execution of a money decree the JD was declared ex parte after the objections were being filed by him and is likely to file an application for setting aside the order on the next date after a period of 50 days from the date of order .Is the move of JD is legally sustainable or we can object the same and under which order and rule ?

Leave without pay from government services

Is it possible to take leave without pay from my current employer with the permission of job? I am in govt service and want to go on leave without pay for one or two years.. During that LWP period I have to do some job for my expenditures.. Is it possible to do so? Is there any provision for that in service rules.. Please advise..

Married daughters rights to father's self acquired property

Sir,
Father died in 2000 leaving behind his wife two sons and one daughter. In yr 2000 all were married. Before his demise he had drafted a hand written document in his own writing and in year 2005 on basis of a court settlement we had distributed properties as per his guidelines. His residence in a piece of land measuring about 1.02 acre was divided in four parts--an area of 4000+ sq.ft. in which a Temple built in his lifetime itself and rest area of about 36000 sq.ft to his three issues (including his daughter). Now as my sister lives elsewhere and land in her share is useless unless sold we advised her to sell. Now possibly prime requisite is change in Varasat of Arazi no of house that still stands in Dad's name. Local officials i.e. Lekhpal /Kanungo through medium of local Lawyers have refused saying married daughters cannot get property. I had approached Tehsildar's office and file has been marked for Lekhpal to do the needful. Request for Varasat change is over one yr old and it should have been done in max 2 months. Pls advise what can be done as my sister may refuse to consider my good intentions and think delay is deliberate on my part. Regards, Dr.S.Sengupta.

IN A SPECIAL CIVIL SUIT PLAINTIFF DIES,

AFTER 180 DAYS NOTHING HAPPENED AND SUIT WAS ABATED WHAT CAN I DO FOR RESORATION OF SUIT?

WEATHER I FILE SPECIAL CIVIL APPLICATION BEFORE HIGH COURT ?

OR ELSE

pLS PROVIDE IF ANY FORMAT?

OR I FILE APPLICATION UNDER ORDER 22 RULE 3 TO THE SAME COURT WHO PASS ABATE OF SUIT ORDER.

iN MY CASE THREE PLAINTIFF ARE THERE OUT OF THREE ONLY ONE DIES REMAINING TWO SERVIVES.

Eviction of relative

my grand father mr. (A) was sold a gunthewari land by register seal deed to mr. (B) (person out of family) within the nagar panchayat area in Maharashtra in 1983 and i have only index copy of this transaction. After two years in 1985 my father Mr . (C) Purchase same land from Mr. (B) and we have index copy and sale deed of this transaction. and we recived nagar panchayat tax receipt is on my father name (C) and we also paid this till march2016. from beginning my grandfather, my grandmother, father, mother, and my two sister and one brother and also my uncle (my father little brother) are leaving on same land in single house. in 1993 my uncle get married and after that there was altercation within the my uncle and my family but my father allow he to construct the house in half part of same land in 2006 without any agreement. we have also construct the remaining part of this land. after that my grand mother and grandfather was expired in 2008 & 2009. my uncle get the electric connection with artificial signed NOC of my father. and he also altercation with my father till date for give the half part of this land on his name. now my family want to evict my uncle from my father property.

now my Question is can my father issue eviction notice to my uncle
