Can I approach the Chief Justice of kolkata high court

Dear Sir/Madam,

I am Sujoy Ghosh the Executor of my fathers estate. Probate of the will is going on since April, 2015. My elder brother does not agrees to the will and had applied for the objection since then. He has failed to file thee caviat and the affidavit in support of caviat on time for two consecutive times. I have appeared in the court room and observed that my lawyer does not speaks up as if he himself is interested in dragging the case for continuous monetary gains. Is there any process wherein, I can approach the Chief Justice personally to explain the case along with relevant documents. Kindly suggest me the process.

Warm Regards,
Sujoy Ghosh

Regarding 138 case notice

I had taken one Consumer loan in 2013 , from Bajaj finance approx Rs 20K for AC. Did all payments on time and Loan was closed and same reflecting in CIBIL. In March 2016 I got mail on my registered Email id that your loan has been approved with so much amount. I simply ignored same considering it to be a regular spam mail . After 1 month i got mail from Bajaj that your loan has been disbursed . I replied on bajaj customer care with all details and clarified them i am not the respective person so pl mark mail to the respective person. 2-3 months later that person stopped paying EMI. Bajaj executive used to come at my residence and creating non sense for collection of payment. I simply clarified all past happening to all executive every month . Also i check my CIBIL, that too affected with negative score. I logged in to Bajaj site and saw all papers given for loan purpose. that was some other person, except name everything like father name , address , bank details was different. I also got payment notices from 3 advocates empaneled from Bajaj.

After doing all Research I sent written reply by registered post with all attachments to all advocate, bajaj delhi and bajaj HO. and also claimed for compensation For Next 3 months I have not received any intimation. Now 2 days back i received notice of court hearing reflecting date when i should appear .

Anyone guide me how to deal with this. Definitely i will go for hearing. and how can i claim compensation for all kinds of shocks given by Bajaj.

Guidance to file wp in the high court

Dear Sir /Madam
Greetings of the day!
I am from a Muslim family. My mother gifted - oral gift (Hiba) the residential property to me on 1st May 2008 in presence of witnesses. I have two more brothers, one is elder than me and the other is younger than me. As such there is no dispute from both my brothers over the gifted property to me. The property was handed over physical possession to me and since then the property is in my physical possession and enjoyment.
The property was gifted to me out of sheer love and affection which my parents have with me without expecting any kind of remuneration from me. As my both brothers left the home ,in pursuance of their educational careers and I was only the son looking after affairs of my parents and their well being. The property which was gifted by my mother is owned by my mother alone.
It seems, later in the year 2010; a third party entered into sale agreement over the same property by advancing an amount of Rs 1,00,000/ - (one Lakh rupees only ) with my mother and the total consideration towards such property was Rs 10,00,000/-( Ten Lakh rupees only). Neither there was information to me about the agreement of sale nor was my consent there in any form to accept / enter into agreement over the sale of the gifted property by my mother.
The agreement states that a sum of Rs1,00,000/- was advanced to my mother as token of advance and the remaining Rs9,00,000/- would be handed over to my mother at the time of registration of the said property. Further, if due to any reason the agreement is not honoured, it seems my mother may have to pay the double the amount of advance, i.e. Rs 2, 00,000/- for dishonoring the agreement.
In the year 2011, the third party approached the Court and deposited remaining Rs 9,00,000/-(nine lakh rupees) with the court and took an ex-parte decision against my mother without making me as a party to that suit. With an intentoto knock away the property. All these events took place without my knowledge
After passing such ex-parte decree against my mother, I came to know about the orders passed by the court in Aug 2015 and I started to contest by filing set aside petition to the ex-parte order granted against my mother and further I filed another implead petition by filing affidavit disclosing about my mother gifting the suit property. The Hon’ble court allowed my implead petition.
In the present situation, myself being the impleaded party, can I file a writ petition before the Hon’ble High court seeking a direction to the present trial court to dispose the present matter with in a time frame.
Your valuable guidance is deeply awaited and appreciated I remain thankful for valuable guidance. Kindly express your valuable guidance.

With regards,
-Moinuddin

Please help my mom's life

Tenant has been residing in our ground floor portion for the past eight years.my mom's s arthritis patient so we decided to make them vacate and I'll be going to ground floor portion so that I can look after my mom's health.so we asked them to vacate but tenant s continuously repairs our house and when we asked he fought with us and brought an interim injunction suit against us.we don't have any agreement copy and for the past three months he s not giving rent.my questions are : in that suit they said that we asked 2 lakhs as advance and increased rent in a particular date by my mom's hospitalized on that date so how shall we continue this case or is there any possibility to compromise or dismiss or withdrawal....Since my mom's bed ridden patient she s suffering a lot...
