Restrain orders from court against registration of Property

Hello sir,

I have filed a suit and got status quo from the court and the case is pending in court.
Meanwhile the opposite party is sending his henchmen threaten me and he is trying to sell the property. They have warned me that they will evict me by force.
Can I complain to police? And also can I pray to court to issue orders to concerned Sub registrar not register the suit schedule property as it is pending in court.


Can seek protection from police as the opposite party is sending goons in to my home in my absence.

Plz guide me.

Regarding arbitaration by the collector

Respected Experts,

Long after i am posting my query here.

I have posted so many querys here and i have received valuable information from you. once again i am going to thank you all for that.

Respected sirs,
My and my near by agriculture lands was acquired by the NHAI for NH-205. The LAO calculated compensation Rs 22/per SQ feet. Unsatisfied Agricultural land owners filed a petition to the Arbitrator/ the District Collector for enhancement of compensation.

During the enquiry the Arbitrator/ District Collector asked to submit a document, previously any land owner got the higher compensation.

So I submitted a previous Arbitrator order awarding Rs 500/ per SQ ft for commercial land and 2/3 of the Agricultural Land (ie 2/3 of 500 is Rs 333 / per SQ ft). RS 167 (33.3%)is reduced for developmental charges from the original Value Rs 500/per SQ ft and Rs 333/per SQ ft for agricultural land.

The present Arbitrator send an order based on the previous Arbitrator order, but the calculation mistake happend in the Order.

Already the previous Arbitrator reduced 33.3% for developmental charges from the original amount Rs 500/per SQ ft and award Rs 333/per Sq ft.

the present Arbitrator must award Rs 333/Sq ft as like the previous Arbitrator, we are also eligible for the award

but in the recent order the present arbitrator again reduced 33.3% from the Rs 333/ per Sq ft and award Rs 222/per Sq ft.

Instead of reducing 33.3% from Rs 500/per Sq ft, the arbitrator reduced 33.3 from Rs 333 which is two times of reducing development charges.

Now I and land owners filed a revision petition to the Arbitrator/The District Collector to correct the numerical error and modify the Award Order.

Now I submit My querys before you the following

1) Whether the Arbitrator/the District Collector have inherent powers to modify their own order?

2) if they have inherent powers to modify their own order, under which act and which Sec?, they can modify the order.

3) is there any Supreme Court or High Court ruling in this regard ?, if so kindly provide the ruling

Bouncing of cheque

I have given cheque for Rs.1.74 Lakhs on 05.06.17 for booking of a Kalyana Mandapam on 15.09.17 and got the receipt. At the time of payment, they have got my signature in a paper stating that if I cancel or postpone, they will not refund the amt.

Unfortunately, I have expected some amt but the same not credited in my acct. Hence, I told the Mandapam authorities today morning (06.06.17)that they need not present the cheque.

But they told take legal action against me for bouncing of cheque. What I have to do?

Harrassment by gated community association

Hi,

I live in hyderabad and have an issue with the gated community association. I paid maintenance which was not acknowledged by them and they have a few months ago cut my electricity.

After sharing the proofs they have restored the electricity and have not yet settled their records and showing me as a defaulter.
I regularly paid my maintenance bills and also submitted the bank statement and cheque details to my association but they are not settling my account. They also claim that they have not received the corpus fund from the builder for which i have furnished the receipt on letter head from the builder which also has the cheque numbers used for payment.

I have been put low in front of my society with my amount not adjusted by them as per the proofs.

Please advise me as i want to proceed legally and charge them for demeaning me in a society where i live.

Reliance jiofi 100% cashback offer with vague terms and conditions

Reliance jio is selling its "JioFi 4G Hotspot dongle" through its website with 100% cashback offer on exchange of old working dongle and 50% cashback offer if buyer does not have old dongle to exchange.

Cashback will be provided in form of additional data, in case of exchange- (Rs. 201 data booster X 10 vouchers)

and in case of without exchange (Rs. 201 data booster X 5 vouchers).

One need to recharge for minimum Rs. 149 or higher to get the benefits of above data voucher on or before 31st March,2 018.

Online buyer need to visit local jio center with invoice and device for availing the benefits

Now, after reading about this offer on their website, I ordered the above mentioned device on 22/05/2017 and received the same on 24/05/2017.

I went to local jio center with proofs of buying to get the mentioned benefits.

Upto my surprise, they said you are not eligible for the offer because you have bought device online and we are not giving the offer to online buyers.

I insisted them to read the terms and conditions mentioned on the jio website. They did not agree, insulted me with their rude behaviour and forced me to leave the store.

I launched a complaint on Jio website through email narrating all these story.

With lot of follow ups, after 6 days Jio care people requested me to visit the same store and said they have spoken to store, I'll receive the cashback offer this time.

With lot of doubts and their requests I visited the same store again, and again this time the store guy denied me for offer and refused to have received any communication from their customer care team!

I called customer care for help, they spoken to store guy.

Then after, store guy said to me, there is lot of confusion, visit tomorrow, we will do something.

Here the twist come in story,
Next day I received call from local jio officer,

He said, you compulsorily need to buy a new Jio Sim to get the benefits of cashback, you compulsorily need to pay 99 for sim +309 for recharge= total Rs. 408

Then the cashback offer will be linked with the new SIM.

If you don't buy we will not give you cashback.

Since, then lots of mailing and phone communication has done, and their only point is, I'll not receive the Cashback offer if I don't buy a new sim.

And my points against this compulsion which came in story after 7 days of buying the cashback offer device,

1) I already have a jio sim bought under prime membership plan and recharged with 303, and there is NO SPECIFIC MENTION IN T&C anywhere that "old customers would not be eligible for this offer and one compulsorily have to buy a new sim to avail this offer".


2) They have mentioned in T&C one can recharge with minimum 149, the fact is, this plan of 149 is not in existence now and it will be in existence probably after July, they are forcing to recharge with 308 only and again this thing is not mentioned anywhere.

3) They have mentioned that one will receive data booster vouchers, after 7 days of buying the device they are saying booster vouchers will be linked with sim and automatically activated.

After raising all these questions to them, they told me about some more T&C which is in PDF form attached on the same website. I tried to read that again there I could not found any specific compulsion to buy a new sim to avail the offer, no specific mention about old customers having JIO Services.

Even that PDF T&C have bearing one point which says "JIO can change these T&C anytime without giving prior notice.

After their lot of force suddenly to buy a new sim with a payment of a good additional amount, I'm feeling cheated.

Their appellate authority is not replying my emails.

Please suggest the right course of action.

Property Nomination Application

My father was passed away in 2003. We registered the death in the same year at village panchayat. I obtained the death certificate two times once for claiming my fathers insurance and second time for inheritance in property specially for farms. I have two farms one is belongs to our village and second one is belongs to another village. In 2011 I have applied for the inherited rights for the farms with all neccessary dovuments at Taluka Panchayat. My village belongs to District Anand State Gujarat. After the application one farm entry has been in the records. They have issued a no. to the entry. Which was cancelled and indicating by lack of documents entry was cancelled. Now I want to review my applications as I submitted two copies of all required documents. So what are steps to review my application. Secondly I visited taluka panchayat in previous week for the same. I asked in office what to do for this at next step. They said apply once again with all the documents. So I visited my village panchayat for obtaining death certificate and succession certificate. As I communicated with talati cum mantri checked the register and said you have not registered death. No record found in register. I also checked personally that in register there is not entry found from february to october for the year 2003. So he denied to give the certificate. Earlier when they issued it was there in register. So my queries are:
1. How to obtain death certificate from panachayat.
2. Shall I review the inheritance application from taluka panchayat for both the farms. If yes then how? Kindly help me out.

Permanent injunction-consequential relief

We filed a suit for declaration with consequential relief of permanent injunction. we have only revenue records to prove ownership. The property was ancestor property and it came to our share and we are in possession for more than 30 years

One of the other member in our family of the property sold the same property through registered deed to someone in the same village. the property was also sold 20 years back and vendor has not taken any steps to take property from us

Now the person who has taken the property has come to deposses us and hence we filed for declaration suit. Since we don't have anything other than RTC in our name for more than 30 years declaration is not granted. However our possession was accepted by the person who purchased the property In cross examination they mentioned that we are only in possession and the person who sold the property from our family also accepted our possession

Since declaration suit is failed, the permanent injunction is only a consequential relief the first appellate court has not given us the permanent injunction also in spite our possession for more than 30 years is accepted by the purchaser also.

What is the relief for us now. The case is in highcourt now. Can we still claim Permanent injunction though we failed declaration suit considering we have only revenue records.

Can you share any case law for this.

Recovery of Money

I have given about 5 lac to one person for deal. He failed to provide me product as per our deal. Now when i asked for refund he always request for some time but he never refunded my money as per commitment. He never denied for refund but also not refunded yet.

My question is what are the best legal way to recover my money? I have transferred money in his bank account by internet banking and i also have all proofs of coversations in the form of SMS messages, WhatsApp messages and recorded phone calls.
