Fate of decree

Since my brother is trespassing into myproperty I have filed a civil suit and the same was decreed in my favor. After that I have filed a EP for the compliance of the decree and the same is pending. At this stage recently i have sold away the property to the third party. Now my question is what about the fate of decree and EP. Will the law provide to transfer the decree to the person who purchased my property or I myself have to continue the EP. At present the decreed property is not in my name. Please give a valuable suggestions on my query.

MACT DARKAST

My father after getting order from court has filed a darkat to execute the order by court and get the money however in said case there is no insurance company involved. Hence the case is filed against individual. The said person does not have assets like property on his name. Is there any legal process through which we can put the peron in jail till the money is paid or any other things that can be done to get the money.

False complaint of fraud

Dear sir
One of my friend is working in bank he has given a loan skcc to party residing in village the loan amount is transferred to party account and cheque book is given now the party has complaint that bank manager and one middleman has done fraud and I have not taken the loan of that amount but taken the only very small loan the middle men party is referring to is his relative the party has voluntarily given the cheques to that middlemen bank has the proof that cheque book issued and loan is given as per policy bank manager presently working there has also visited the police station and given the statement that paper in bank is in order now I want to know that how the process will go further what police will do

How to prove document

I have filled suit for damages against insurance company and relied upon the survey conducted by authorised IRDA surveyor however the survey report was misplaced and I therefore sought permission to rely upon the copy of the survey report as secondary evidence. I have also applied for examining the representative of the surveyour who conducted survey however I could not trace out his address and now query is how can I prove the survey report. it is to be noted that the survey report says about quantity of loss i.e. shortage of metal to the extent of 3620 Kg. that defendant has not disputed the report in the written statement, Please advice me, Thank you in anticipation.

Does possession necessary for "declaration of title" suit.

Good Day !

I "A" have purchased a part of property area Sub Registrar registered from registered GPA holder representing X, later a person "B" is said to have acquired Validated NRI GPA from X again and registered the same property in another Registrar office. "B" is police officer suspended on our complaint and has occupied the property and is in possession. Should we file suite for injunction or declaration of title ?

1) GPA does have a clause for sale right to GPA Holder and GPA is still active.

Money debt recovery

1)Principal creditor send me the legal notice for first appearance in court for money suit.
2) But,before the case comes to the court we both were settled the matter amicably and creditor has given his consent to withdraw the case.
3)Is it mandatory for the debtor to appear in court on first hearing.

Counter claim against permanent injunction

A dafulter tenant has put a case of permanent injunction against eviction.
First 2 years landlord not appear , tenant get ex-party order
but there after tenant is not appearing 3 years in court.Case still is
not disposed.Now, Land lord appear , appeal court with genuine proof
of reason of his absence and appeal court to vacate the ex-party order and counter claim the eviction.

My question is counter claim to eviction is admissible in the case of
permanent injunction ?

Is there law that counter claim is not admissible ?

I am in a dilemma , one lawyers says counter claim admissible and some lawyer says
we need to file fresh eviction suit.

Divorce

Three years ago, my friend's daughter was enticed to marry a person. She was threatened and forcibly married. She was tortured mentally and physically by hi and his mother. She was not allowed to worship god. She was not allowed to continue her education. She was not allowed to fetch a job. She was living under threat. When things worsened, she left his house about 2 years. No cohabitation from that time. Though she could file DV complaint, she did not on advise by her father. Now she wants divorce. He is not consenting. No documents or evidence on her behalf.

What best she can do? Can she succeed?

Nomination in co-operative housing society in maharashtra

I want to make my wife as Nominee of my flat in our Co-operative Housing society Society which is in Navi Mumbai, Maharashtra, I need to know the Procedure for the same, Society has given me a form 3 copies to fill the same & submit to society,
I want to know do after submission to society office is it enough for Nomination registration or I need to Society Registrar Office to or CIDCO (Regulatory Authority of Navi Mumbai).
