My friends and legal experts- I have a question, my father married another woman while current divorce case in process, his illegal wife gave birth to a child in 1995, but actual divorce case was finished in 1997, he gave birth 2 years before he got divorce .....I am the first wife son. Can I file in court based on illegal child birth certificate. Can I make punishable to his illegal wife now and my father.... what are the pros and cons....!!!!

I got preliminary decree in a partition suit. I applied for final decree proceedings as per the preliminary decree to appoint advocate commission. My counsel did not deposited process for some reasons inspite of reminding by the court and got delayed. My counsel filed restoration petition. My restoration petition for final decree was opposed by the other party. The case was posted for arguments and the same is closed. Now my counsel and myself are waiting for orders for last two months. My final decree application does not attract limitation act and it is an application in a pending suit. Further there is no appeal pending in any court still the trial court is not pronouncing the order inspite of my counsel requesting for order. Why it is delayed for pronouncing the order is not understood by my counsel or myself. Please kindly advise what to do to expedite my final decree proceedings.

I want know in OA, whether endorsement by other side ( petitioner) advocate in vakalat is must. I am for the respondent, my vakalat is returned because there is no endorsement by petitioner's advocate. I think it is must for memorandum of appearance.

In respect of a properly all the family members executed a memorandum of understanding and divided the property in the year 2001and the same was notarised. Recently in a civil despute a question was raised abouts its authenticity since it was not registered. Learned advocates please advise is registration is necessary for memorandum of understanding between family members even through it was notarised.

Sir I would like to know that if there are suppose 10posts for exserviceman(general) category in a Recruitment. But only 2 candidates of this category qualify the exam and 8 posts are left vacant. then can these posts be converted into their open pool i.e. General category?
because I have read that if Exserviceman(Sc/bc) posts are left vacant then they are converted into their open pool i.e. SC/BC category. will it be applicable for Exserviceman(general) too??

I have obtained money decree against the deceased father during his life time. After his death his son got his father's job on compensatory grounds. can i recover the decree amount from son by attaching his salary.

can open space be used for parking in chs ?
I am the chairman of the New Harischandra CHS Ltd, Virar (East) having 32 flats and 2 wings. Initially society has some Garden area and due to some non maintenance of the same children play material like sea saw and other got rusted. Hence new committee has removed them and the garden area has become plain ground with just grass grown on it. I became chairman of the society 2 years before as the existing one has resigned. Some members started using it for parking their 4 wheelers and also paying maintenance for parking. Some members are raising objections and they wanted the space to be used for children play and for sports activity as well. Managing committee has decided to concretise (koba) the same open space and the same has been put in AGM. Very few members have taken objections for the same and majority approved. However matter has been escalate and many members feared that place may be used for parking again and they wanted the space to be used for playing activity and accordingly demand that space should be converted in to lawn area . Building plan does not have any parking space allotted and said open space has been shown as garden area. Please advice. Thanking you in advance..

I HAVE WON AN OS IN MONEY SUIT AN EP WAS FILED . KACHITDAR WAS ASKED TO PRODUCE THE ITEM THEY PRODUCED ONLY 12 ITEMS OUT OF 33 ITEMS OUT 12 ITEMS 2 WERE DIFFERENT BRAND FOR WHICH THE COURT ORDER TO PAY ME RS 20000/ IN EA 345/2009 - FOR THE TWO COMPUTER . THE EP 14/2007 WAS DISMISSED IN DEFAULT
I FILED A SECOND EP FOR SAME OS 173/2005 . NOW THE QUESTION IS WILL THE ORDER IN EA /345/2009 IN EP 14/2007 STAND STILL STILL THE KYCHITDAR HAVE NOT ADHERE WITH THE ORDERS
