Application

Sir right now i am practice in district Bijnor.I have seen many our senior advocate make different kind of application to the court even though there is no provision of these application in C.P.C.For example application for getting amendment copy of plaint. Sir i want to know is it valid application?

Suit for Declaration,Injunction without asking for Possessio

Facts of the Case-Joint Hindu Family(father & Sons )partition took place,separated son got his name in the property,son and his wife died-Only heir their daughter,her name came on property,she sold theproperty(agricultaral land,uncultivated)by regd.sale deed.Dispute arose between the purchaser & relatives of Pltff.Purchaser & seller(daughter)filed suit for Declaration & Injunction.Court in its judgment found Dec.& Inj.proved, but only on the statement of seller(daughter)held that she was not in physical possession & the relief of possession has also not been asked,hence dismissed the suit on this ground only.Although the defd.also did not prove their possession.
Q. Whether the suit can be dismissed only on the ground of tecnicality of not claiming possession for.(O.7R.7 & S.34 Spe.Rel.Act)? I was for Pltff. Have filed appeal-So need opinion and ruling.

What do u mean by CHARTERED HIGH COURTS ?

What do u mean munsiff courts? The limit for filing the case.

Pls give me the limit to file a case under the various courts regaridng all the matters as i what to make the project on it a complete project in detail so pls help me if possible with the examples. eg: under various high , supreme, munsiff, district , small cause courts. also difference between Sub - ordinate court, Munsiff Court, District Court & trial Courts ?

What do u mean by the word Trial.

(e) make such other interlocutory orders as may appear to the Court to be just and convenient.

Civil Procedure code (Affidavit).

2. Power to order attendance of deponent for cross-examination


(1) Upon any application evidence may be given by affidavit, but the Court may, at the instance of either party, order the attendance for cross-examination of the deponent.

(2) Such attendance shall be in Court, unless the deponent is exempted from personal appearance in Court or the Court otherwise directs.

1)What do u mean by deponent ?
2)When attendance of the deponent is exempted under what conditions any case laws. or notes.

141. Miscellaneous proceedings.


The procedure provided in this Code in regard to suit shall be followed, as far as it can be made applicable, in all proceedings in any Court of civil jurisdiction.

Pls Explain Learned Experts it is a kind request. I have gone through the act but not understood so pls clarify.

Arbitration dispute

Respected Members,
Arbirtration proceeding regarding service tax is pending in my company .The arbitrator asked us to file original contract agreement on record as per c.p.c
1)whether is it proper to file original on record ,
2)
if arbitrator refuse to give original after arbitration award what Action to be taken
3)if arbitration award passed against us ,we definately challange in Hon'ble high court , can high court call the record of arbitration procceding from arbitrator
