RS. 10000/- COULD NOT BE RECOVERED BY PREVIOUS COMMITEE UNDER FOLLOWING CONDITIONS:
1. EGM HAD SANCTIONED RS.80000/- TO BUILD OFFICE. CHEQUEOF RS.40000/- WAS ISSUED TO CONTACTOR ACCPTED BY EGM.
2. WORK STRATED BUT COULD NOT BE COMPLETED BUT HAD TO STOPPED DUE TO POLICE COMPLAIN BY NEBOURING SOC.
3. WORK COMPLETED WAS ESTIMATED BY COMMITEE TO RS.30000/- HENCE CONTRACTOR WAS ASKED TO REFUND RS.10000/- BUT CONTRACTOR REFUSED TO OUR ESTIMATE HENCE HE GAVE BILL OF RS.40000/- & REFUSED TO REFUND.
4. MENWHILE COMMITEE HAD TO RESIGNED DUE TO HARRASMENT BY A MEMBER.
5. NEW COMMITEE CULD NOT BE FORMED HENCE ADMINISTRATOR WAS APPONTED.
6. NOW NEW COMMITEE IS IN PLACE. RS.10000/-
ARE SHOWN DUE FROM CONTRACOR SINCE THE DISPUTED YEAR 2006 TILL DATE
KINDLY ADVISE COURSE OF ACTION FOR NEW COMITEE.

Dear Friends of the EXPERTS forum,
Kindly clarify me in a sale transaction / s:
Person 'A' obtains GPA from 'B' and sells 'B's property ,here he did not mentions the word ( in the document ),as a "GPA holder he is selling this property "! Will this be a lacuna in the sale transaction / s ? Can this be challenged in court of law for cancellation of sale deed/s ?

sir i live in a private property which is located on a private road ie the road also is a part of private property the place where i park my vehicle is dead end ie after my car is parked there is hardly few meter of road till where a vehicle can go recently some one has complained to traffic police that i am obstructing the way of people and traffic police is threatening me that they will tow my vehicle and every now and then they are comming with towing van inside my lane which is a private road but as traffic police are meant for public can they exercise their law on private road is there any law section under which i can prevent them from doing so
any help would be appreciated

Respected experts,
In a demarcation case the circle officer has passed one sided order intentionally since he did not get any bribe, and has committed several mistakes during manipulation in haste, some of them are serious in nature. False report prepared and manipulation of order sheets itself proves the malicious intention of the officer. Every evidence is in the form of document. Like that he blackmailed and harassed me for complete two years, when he became sure that he cannot extract anything from me, he has passed the order. Do govt. officer has right to harass since the facility of appellate authority is available? Can they be charged for malicious proceeding initiated, if sufficient proof is available? Can we seek compensation of our suffering?

I am a builder by profession.I am from maharashtra.i have a town planning sanction of 54 flats and i have constructed 24 flats in the project.Sir the people of 24 flats are hurrying up to make a society but i dont want to make the society as they will creat problem in the remaining project.They have applied registrar for the same but i have not responded them.So sir tell me what is exact solution for it as i dont want to make society for them.

Dear experts,
I need you great help and advice.
I am married and working with on of the best multination company in Mumbai. I usually travel a lot for my business assignment. As such I used to get my company car or taxi for travelling but one day I and my sectary was returning from our assignment, as she was having her farm house on our way so she offer me to see her farm house for which I also got agreed. There was no one except her watchman. We halt there took a cup of tea and decided to return back. We were just planning to leave and suddenly rain has started and unfortunately my car broke down (unable to start). It raining so heavily and no mechanic were near by so we decided to halt there only. I was sitting inside the farm house and in that mean time she asks her watchman to bring some food and whiskey for us. As soon as the watchman gave us the food she told her to go and not to stay there for that night. I told her that in any case watchman can help us in need of something as he is friendly with this location. She offered me whiskey which I denied first but she forced me so much that I got agreed and she also gave me the company.
We drunk till midnight. We both gone into unconscious mode and unfortunately we got involved in physical relation. (I know it is wrong but it was done under unconsciousness and mistakenly without any intention)
Now she is pregnant by a month and asking for huge amount for keeping this secret and also threatening me that I will not give her money and promotion in my company she will do the police complaint and also will prove that I took her into my car to the farm house (as my car was repaired next day in a garage where my car no. was noted.) that I have raped her. She also told me that she will tell police that I forced her watchmen to not to stay there.
Now I understand that she had planned this before only as she know that I love my family very much and I am also too social.
Now kindly suggest me how can I come out of this can I take the help of police without coming in knowledge to my family and my company.
What else I can do now???

Dear Experts of the forum,
Here i have a typical problem : My father got some property through a WILL. But this fact was suppressed by some interested persons, and known to us only two years back. In the mean time my father fell sick and died. But, before his death he wrote a WILL on my name in regards to the above property. But sad part is this ( Earlier this was an Agricultural land )land made in to plots and sold to different persons and even some is occupied by Government(?).
What should i do now ? Can i claim this Land back ?
What role does Limitation act play ?
Can the plot owners claim this property under Adverse possession or under a reg. docmt.?
Can Article 226 is of any help to me?
Or, is there any course left to me ?
Please GUIDE ME.

Partion suit pending exparty can back an join the suit.
Brief summary
X had filed a partion suit in 2004 for the property of their father against 4 brothers and 2 sisters only the petitioner and 2 defends are filing the counters. other defends are not contesting the case and got exparted.
Still the partion suit is pending.
Q1. if the Petition filed by petitioner (X) praying the court to withdraw the his claim from the suit property. Does the court closes the suit without sending the notices to the ex party defends or what is the procedure.
Q2 if the partition suit is pending can the ex party defends can join in the later dater or not.
Q3. Can the Ex party defends can file a another fresh partition suit if the petitioner (X) closes the main suit.
