we were 4 brothers and 5 sisters, one of the sisters who died recently had earlier claimed her share in parental property by challengeing mutation in 1994 in revenue court, mutation was done in records in 1977,
now she had withdrawn her case in oct 2009, in the civil court again she filed the suit claiming her share in parental property and made an appeal that she had not withdrawn her case infact it was fraud by his brothers,by makeing fake sign of her.(obviously ,this is false) actually her children forced her to filed the case again she had withdrawn as its very huge property. now, she had written 2 wills 1st WILL is registered and is with her children. the 2nd WILLis in the last will that is there with her brothers in which she has divided her property amongst her children and had admitted that she had withdrawn the case against her brother and she does not want any share like her other sisters who have release their rights in parental property by registered released deed but the sister who died had not registered a release deed but insted had mentioned about releaseing her right in her last will which is duely signed and thumb impression is also given but not a registered will. what do you think the declaration made by her in last will regarding releaseing her rights in property will be considered by court. her childrens are now claiming their share after her death. kindly , provide me with your valueble inputs.
Indian partnership act 1932 sec 69 bars suits by any person claiming to be a partner in an unregisterd partnership against existing or past partners sec52 gives a partner the right to rescind a partnership agreement on grounds of fraud or misrepresentation QUERY does sec 69 apply in suit based on sec52?
Respected experts,
I had sent a legal notice to the Defendant via speed post, but even after a week I did not receive the acknowledgment of delivery, though it has been delivered.
I registered an online complaint in the India post office site and received a reply online stating that the notice has been delivered.
Would a print of this communication suffice in the court to show that the legal notice has been delivered to the Defendant ?

Dear Advocate !
A "patta" is on the name of a male member from the year of 1940 based on his enjoyment.
There are 4 legal heirs to the deceased male member. 2 of them are FEMALE.
Now, the 2 male members are willing to go for partition between them.
My Query is :
Whether that 2 female members having right upon the undivided share or not?
If they have right upon it. Is Witness signature enough for partition between male members?
Pls. reply.
Thanking you

This is in relation to Haryana.
my tenant has agreement excuted in his and my name. In the agreement it is clearly written that he is now a tenant and i am the land lord. Now as allegged by the tenant my other brothers are asking for rent from him after more than 20 years of tenancy with me. I have been getting rent directly as well as for last 10 years thru court. I filed a suit for his eviction on ground that he has a bigger and better shop purchased by him after 5 years of tenancy in the same market. in this eviction suit he filed a application under CPC 1 10 for impleading other co owners. Which was dismissed. After one year of dissmissal (when the order of 1 10 had become final) he filed an interpleader suit. I want to know is this interpleader suit is legally maintainable. I have filed a application for rejection of suit for no course of action under order 7 rule 11.
My question is is this conduct of tenant not itself a ground of eviction ??? Is this interpleader suit legally maintainable ? also i need accurate interpretation fo order 35 relating to tenant filing an interpleader suit.
Inspection by civil engineer.
I filed a suit for damages against the leakages caused by the owner of flat above mine.
Should I file a separate application for inspection by civil engineer to assess the damages or is there some other procedure followed by court?
