Daughter's right in ancestral & self owned Property of deceased father

Sir, Madam,
My wife is the one and only daughter of my father in law and he gave divorce to my mother in law when my wife is at the age of 3 years. Laterwards he began to maintain relationship with my wife and he himself conducted our marriage and continued our relationship. Recently he expired and he lived with one lady which she is already having 2 sons by her first husband.My father inlaw is not having any children with her. Now my doubt is whether my wife can claim right to property as a daughter and can claim Job on compassionate grounds from BHEL. What is the procedure to acquire legal rights in property which includes ancestral property. I am having one son and daughter. I would be very much thankful if you provide me assistance. what is the freehold property. Can I use this property for commercial purpose if it situated on nearby commercial road.At present this land is residential.Now i want to take without any permission to use this land for commercial purpose.

Regarding Court Fee

Learned Experts,
I am about to file a civil suit for removal of encroachment of my land by my neighbor. Here I have to pay the court fee. If in the meantime out of court settlement happens then can I get the court fee back? In this situation what is the best option for me?
Plz. Guide me.

Writ for directions to The Comm. of City Corp.(Municipalty) & Police

Dear Sir(s),
There is a passage to lay the drainage line which the owner is not allowing to put it is around 47 ft along the border of the plot.The passage is around 4 ft-9 inch. The owner(my Younger brother)of that plot is perposely constructed a unauthorised structure, by which we can enter to put the UGD.This has been costructed after we got temp. injuction by OS.
We complained to the commissioner & police to demolish that & facilitate us to put UGD.Commissioner inspected with his team & agreed that its unauthorized. We requested him to direct for demolition & help us put UGD. He is not taking any axction past 3 months. I am Sr,Ctz & have no UGD hence staying in rented house.
Now, I want to get the direction to Commissioner & police to act from the HC in Karnatak to make use of Byelaws 229,231,236 etc of Kar.Mun.Act 1976 & help us put UGD.& prevent further mischief forever.
I complained/represented to local MLA, DC,Councellor,Lokayukta,Minister for Urban Development/law (who seems to be man of action) for inaction of Corp. What do I do? How much time will it take if I approach HC? Please guide I am 76 yrs old.fighting for justice. The horrible Commissioner went to the extent to suggest me to dispose off the house.I need early & implementable justice..

partial partition

Plaintiff filed a suit for partition, i am appearing for the defendant, i am taking the defense in the above the partial partition is not maintainable and further in my cross examination the plaintiff also admit that the plaintiff is have the some other ancestor properties, but he is stating that the said other properties is concern no dispute hence he is include the other properties, but the other properties are the plaintiff got possession now i have for partial partition is not maintanble.

pls give the authorities in the above aspect

Notice period during probation

Dear All,
I joined a company and the clauses of the appointment letter are as under.

I left the company within three months of joining with just 1 day notice. The company is just behind me and demanded six months gross salary as per the terms of the appointment letter as below. I fought for them in the civil court and the judgement went in favour of the company.

Would be grateful to the advise of the learned people with the options that I should exercise now.



The clause 3 of Appointment Letter reads as follows:

"You will be on probation for a period of TWELVE MONTHS from the date of joining service which may be extended at the discretion of the Management for such further period or periods as the Management may deem fit".

Clause 4
You will be confirmed on completion of the probationary period if your service is found satisfactory.

Clause 5
You will abide by all the Rules and Regulations of the Company and code of conduct made applicable from time to time to Managers.

Clause 6
Your service can be terminated with six month's notice or payment of gross salary in lieu thereof. In the event of your resigning the job, you shall give six month's notice or six month's gross salary to the company in lieu thereof.

My father's property - ?

Hi,
My father has 4 childeren . I am last son and 3 yelder sisters. He did marriage for only 1st sister- 1978/79. 2nd and 3rd sisters are left home and they performed love marriages and not returned .

My father was having 433sq yard plot(own property) at Rukminipuri and in that 83 sq. yard has given to my 1st sister as a gift deed.

Later when i was in USA he sold both the houses and not given a 1np to me. But he constructed a double storied house at Moulali . And also my sister constructed house by the side .

He expired on July 10th of 2009. He wrote a Will that after his death if my mother is alive she can enjoy and universal legesy for the whole property and after her death it will come to me.

My sister took my mom to her house and kept her and i occupied upstairs. She kept lock and i came to know that she has taken a signatures from empty papers . Then i have taken a interm injenction order from court 9th Sep 2009 - "Not to Elinate".

On 25th July 2010 my Mom expired. My sister filed a case that my mother has another Will (registerd date - last week sep 2010)stating that she has given the whole authority against property.

Will i get my property ? or i have to loose the case.
