DOES THE CERTIFIED COPY OF THE DOCUMENT HAVE SAME MATTER AS IN THE ORIGINAL REGISTERED DOCUMENT???

Salary not disbursed despite of CAT order

I am the legal counsel of my brother who has been working in Autonomous Govt Office on adhoc basis. I have filed the petition in the CAT in year 2009 in regards to non appointing on regular basis against the vacancy which was created. The CAT has allowed the petition and has given direction to consider his appointment on regular basis with in 3 months

The adhoc tenure of my brother expired on June 2010

But his employer didnot complied the order and has also with held the salary since July 2010 as result I have to file the contempt petition and the counsel of his employer submitted that salary will be disbursed to the Applicant (My brother) with in 2 days and will move to the High Court against the order for regularisation

This infuriated the CAT and has given direction to comply their order or else chairman(Employer) will have to be present before them

The High Court has remanded back to CAT for reconsideration as result the CAT has to close down the Contempt petition and now the matter is still pending there

I also appeal against the order of High Court before Supreme Court of India by the way of SLP(Civil) with interim relief of releasing the salary. The Supreme Court find no merits in the appeal and has advised to made representation before the CAT

The employer in ter alias has terminated the services of my brother in Nov 2010 on the basis of verbal directions. I agin filed the fresh petition in the CAT which was admitted and issued notices to the respondent employer and next date of hearing in Feb 2010

Now the issue of releasing the salary has gone into deadlock as 2 petitions has already been pending before CAT

Is there any alternative remedy for providing him the interim relief atleast of releasing the salary which he has worked there from July 2010 to November 2010 and the employer has given submission that salary will be disbursed with in 2 days which is also on records of CAT order

as I can only filed the petition at his interest any suggestion in regards to this will be fruitful?

Partition Suit

Ancestral property devolved to Mr.X. He got 2 daughters and performed their marriage. Elder daughters husband died. Then she came to parental house with children and performed marriages of her children at her parental house and leading life there. Mr. X and his wife died intestate. There is a property about Ac.6 and a house. Now this elder sister claiming the property by not giving share to younger sister. Can younger daughter of Mr.X can claim the share of Mr.X, who is one of the daughter. If yes, is there any case laws mostly Supreme Court case laws reguarding on this point.

C P C

In the suit set exparte against me I have field Affidavit with
Petition u/s 5 of limitation Act for condone delay of 453 days to set aside exparte decree,
Petition under order 9 Rule 13 of C.P.C.
The Respondent has field his counter .
I referred the book "Law of Limitation " by
Hari Dev Kohli , and find many judgements to support my Petition u/s 5 ,
I feel my Affidavit has to be Changed , to add additional points to support my stand .
The suite is before "Asst City Civil Court At Chennai.
HOW DO I PROCEED ??

What is this Order 9 Rule 13 ?

I find there are so many volumes on C.P.C.

I want to buy a GOOD BOOK reasonably priced , giving all about C.P.C.
Please suggest me a good Author

Federation law

Please provide the basic laws for forming a cooperative housing society federation. I would like to know the following.

Civil suit and No. of Plaintiffs

Learned Experts,
Six persons are legal heir of a land, out of them four lives outside. Only two lives, son with his father who too is one of the legal heir, in the home town where the land situate Now a civil suit has to be filed for removal of encroachment of the land.

Can the person who is taking care of the property alone be the plaintiff of the suit or name of others too are reqd as plaintiff?

What if both son and father become plaintiff?

Will the suit be barred due to mis or non- joinder of necessary parties?

Plot abutted on Public street of area X have its back on public street of area Y

In above situation, can owner of the plot have right to open door on public street of area Y, which is at its back. if so, then please help me out with a latest citation. Please note that the area Y is not a private colony etc. The Plot is in Ludhiana city.

Can matter which is not raised in the notice be asked in the Plaint in partition suit?
