LUNATIC PROPERTY

SIR,
MY QUERY IS IF A PROPERTY IS JOINTLY OWNED BY MOTHER AND HER LUNATIC SON CAN THE MOTHER MAKE WILL??? IF SO WHETHER SHE CAN MAKE THE WILL FOR WHOLE PROPERTY???

i sold a property to a person x by virtue of a 'sale agreement' and 'unregistered sale deed',does this complete mysale?.now iam selling another property of mine and the person x says he wants a share on the sale or will obtain a stay order since he cudnt obtain patta which he agreed to obtain himself.is this possible?

EXECUTION OF DECREE

RESPECTED ESPERTS,

if order is passed in favour of me but same court is showing reluctant in excution the order passed by his own court thouugh i have made a sevral application for excution of same.

what are legal option left to me in such circumstances.???
Should I make application to high court or district and session court for excution of order.??

Partition and Shares in Muslim Law / decree against dead person



My friend filed a civil suit for partition of house/s property of Muslims. Father died, suit filed by male person [sole son] of the deceased father. The property is his father's property. His mother and sisters as well as tenants were made as parties to the suit. The suit filed in the year 2002. The suit decreed in exparte in the year 2009 and preliminary decree is passed. The first defendant i.e. mother of the plaintiff died in the year 2004. But my friend did not informed to the court, though all the legal heirs of deceased mother are on record. Now the suit is decreed against the dead person. Can he file the final decree ask the shares at present entitlement of the parties? or whether the suit is required to reopen for amendment of the preliminary decree by incorporating the information of the death of first defendant i.e. mother of plaintiff?

Where 57 came first or 58 came first .Sub section line .

A sub section in a act refer as per the below so what actually does it conveys about the figures given in the bracket 7 outsside the bracket which will come first.

57[58[(15B) " child " in relation to an individual, includes a step - child & an adopted child of that individual.

Foot Note .
57) Inserted by the amendement act, 1975.
58) Inserted by the amendement act, 1987.

So actually my querie is where " child " in relation to an individual, includes a step - child came first or & an adopted child of that individual. came first how to know that in this abovementioned sub section which came first .

in short which line came first the line before & which says & an adopted child of that individual.or the line " child " in relation to an individual, includes a step - child 57 is applicable to which line & 58 is applicable to which line.

police aid

can there be a police aid in the injuction petition i have heard there cannot be police aid in the injuction petitions what are the apex court judgements in this case if the expperts thow light on this aspect i would be grateful to them thankyou in advance.

land & revenue

Dear sir/madam,
Ours is a registered co-op.Hos.Society in Andheri,Mumbai from a very long time. We all members have paid stamp duty & have seperate agreement from the builder for our flat which clearly states Free hold land. The builder owns the adjoining plot on which he has started construction.Recently a notice was received by the Chairman/Sec. from the land revenue dept. to meet the concern Officer.
On meeting the said officer it was stated that our society's name was deleted from the land revenue record & instead the builder's name was included.Now as per the recent record the builder becomes the lessor.It is but obvious that the Officer & the builder are hand in gloves.I hope my message is sound and clear.
My Question is:
1)Can an Officer make such irregular changes
2)Does it not violate our civil & legal rights.
3)Can he do so at his whims & fancies creating such a big blunder.
4)What action is necessary to get things
done from our side in legal manner to get our society's name on the land & revenue record.

2nd party relocating.What can be done

I have lodged civil and matrimonial cases against my inlaws and my wife.Like section 9 of HMA,Injunction suit and showcausenotice.They did not turn up in any of the hearings and now they are relocating.That is now they are changing their Address.Are they required to notify court about their new address.What can be done.

AND CAN A LUNATIC PERSON MAKE POWER OF ATTORNEY?

PLEASE TELL ME HOW TO PROVE THIS UNDER WHICH SECTION OF ACT TO PROVE IN THE COURT.
