Sir,
I was given a cheque to him as token money against property, i said him that the same cheque will be encashed only if makes agreement with me in written. But he did not make any agreement with me nor return cheque to me. I had number of time visited in his office with my wife, he did not given back my cheque. I compelled to close my saving account from where that cheque was given. When he presented the same cheque into bank, the bank return the cheque to party with remarks "insufficent fund". Now he has filed suit upon me with the demanding Rs.2Lac under section 138. He is saying that he has given cash loan to me against the same cheque. Please suggest me

Sir,
It is brought your notice that my income tax lawyer has filed suit on me with the debt liability of Rs.2Lac and he has also presented a cheque into my bank of the same amount which has already been returned with the remarks of account closed. Actually, the same blank cheque was given by me for purchasing property from him in 1995.whereas I had not received any single penny from him nor signed any documents. Please advise me.

contradiction between oral and documentary evidence, than documentary evidence is admissible.

THE TURST IS IN GUJARAT. THE TURST HAS NOT SUBMITTED ANY DOCUMENT SINCE THE INCEPTION OF THE TURST IN 1982. DURING 2005 ONLY ONCE THEY HAVE SUBMITTED NEW TRUSTEES NAME. TILL DATE THEY HAVE NOT FILED ANY BALANCE SHEET, AUDIT REPORT OR MINUTES BEFORE ASST. CHARITY COMMISSIONER. NOW THEY WANT TO REGULARISE THE MATTER. CAN THEY DO? IF THEY FILE CURRENT YEAR AUDIT REPOST ETC. WHETHER THE CHARTITY COMMISSIONER WILL ASK FOR EARLIER YEARS REPORTS? KINDLY GUIDE IN THIS MATTER.

Sir,
In case of service matter before CAT, the decision of case has gone against me and I filed the Review Petition which has issued notices to the Respondent but get adjourned due to absence of the bench and now more than 3 months has passed and there is no fixed date of hearing has come
My query is whether I should go ahead and filed the writ Petition before the High Court?
What will be happen if writ petition is dismissed should It affect the order of Review Petition?
Or I should wait for the review Petition and thereafter, I should filed the writ Petition
PLEASE ADVISE

Dear Sir,
I have case against builder. I am overseas and not conveninet for me personally to show up in the consumer court.
1) Is it mandatory for me to personally come from overseas for showing original documentary evidences in the witness box on oath during examination in chief ?
2) Do court dis-allow SPOA to represent on my behalf for this matter?
(I already have SPOA attoreny appointed to stand before forum on my behalf. In addition, my lawyer is there to fight for my case. During filing, I already sumitted on oath affidavit, all the declarations, all claims and justifications and copies of evidences to support my case support.)

Sir,
I have consumer cout complaint against builder which has admitted in the state forum. I have engaged attoreny and a high court lawyer since 1 year as I am overseas. I promptly pay for his service. I have noticed he is not deligent in his work towards my case and in spite of cautioning, he made mistake in prayer for which he filed amendment. But he billed huge amount. When I asked justification for charges he scared me of giving up service at this moment of my needs.
How to deal with such situation? I am frustated with this lawyer's grossness and upperhand in dealing with my case.

Sir recently, i have taken a vacation scheme from a company, i made an agreement with the company for an amount, out of which i issued a cheque for part of amount. the day after i issued my cheque, i came to know the company services are poor, let me if i can stop them realising my cheque, is there any way, if at all i do so what problems do i face

Sir,
Someone person has filed suit upon me with a debt liability of Rs.2lac against cash loan. Whereas I have not received any cash amount from nor signed agreement. He is misusing my old blank cheque.
