Dear learned colleagues,
As per report in Times of indaia 25-3-2011, UT District Chg. consumer forum passed orders to refund ammount deposited by Sh. Mehta residentof Sector-6, with interest and cost of Rs. 20000/ for not building & handing over the flat with Parsvanth Builders to this buider. How can I get this order./ judgement on line or other wise.
If any one of my learned colleagues have this judgementthen kindly send to me and oblidge as I intend to file similar personal case against this Builder for cheating and non fullfilment of its obligations/ service.

My company is in construction business and recently change its name in accordance with sec-21 of company Act 1956 and added some directors. Wehther the resolution pass by company, before its change of name, authorising a director as authorised signatory for a re-development project of a society needs to be pass again by a renamed company or the old resolution is sufficent to continue the authority given to a director. The said director is still on the record.

Dear sir,
I would like to seek advice on the following queries regarding property from your panel of experts. We are residing in a new housing scheme in Pune having six buildings of four floors consisting of 32 flats in each building ie total 192 flats with amenities like parking, park, temple, gas pipe line, lift,inverter back up,Gym,comunity hall, etc. Now all the flat owners have taken the possession and builder has to form the society.Kindly give the advice and the expert openion on the following points.
1 Under which act society has to be formed since we want our right on
the land and other amenities provided on the said land.
2 Whether the society of individual building or whole scheme of six buildings jointly or one main society with sub societies of six buildings under the main society is advisable.
3 Whether the builder can keep his control over the temple and form a trust under his chairmanship or has to handover to society.
4 whether the builder has to hand over community hall and gym to the society or can keep under his control.
5 Whether the builder has to handover all the one time maintenance
amount taken by him in advance to the society with interest. What
amount he can deduct from the said amount while handing over
the same to the society.
6 Whether the builder is responsible or not for, to see that all the flat owners are getting sufficient water supply before formation of the society.
7 Can builder keep any right over any property of the housing scheme.
8 Which other things the flat owners have to see before the formation of the society to avoid disputes in future and any other advice they feel suitable for the benefit of flat owners.

sir ,i am preeti 30 years old un married hindu girl.i have a brother whose age is 34. my father had a 20 acre land,from his father. in an accident my father and mother died in 1988.my father was only child of my grand father. now my brother has refused to give any share in the ancestrol land. how can i get my share and how much share would i get. we had not partioned since our parents death. before my parents death the land was in name of my father, then my brother got his name in records, i dont know how, and why i was not added in nominations?plz tell me would i get my share or not and how much share?

A is the share holder in family agriculture land with name in revenue records, in 1959 family sold land to company after govt notification for acquisition, leaving A share unsold , award announced in 1962, name of A not included in award, A was minor at that time & didnt have any knowledge, but land become surplus land as purpose for acquisition already completed without this land , so govt didnt take possession at that time , no notification u/s 4 , 6, 9 issued for award only notification 3 and finaly award in 1962. in year 1979 govt taken the possession of land after court order in a case where owner of land company or A were not the party, dda lost case intentialy and dda disposed of land to society G, some parts of land still used by us for cattle grazing etc. this remaining part of land was allotted to another society X in 2000 but allotment cancelled after 2 years. soceity X fighting a court case for cancellation. As the land still vacant was surplus land & govt has no pupose for this land , and A compensation was also not paid & procedure for award was also controvertial.
Q 1- can A get back his land ?
Q-2 can A claim for compensation &
alternative plot ?
Q-3 can A claim for denotification of land u/s 48 of land acuisition act?
Q-4 can A challenge the procedure of
award?
Q-4 can get any benefit to became party in
court case pending?
What will A do?

Bombay High Court Rules
Chapter 1
1. Jurisdiction ordinarily exercised by Division Court of two Judges. - The Civil and Criminal jurisdiction of the Court on the Appellate Side shall, except in cases where it is otherwise provided for by these rules, be exercised by Division Court consisting of two or more Judges.
I. Civil —
(a) Appeals. — (i) from original decree in suits or from adjudication in other proceedings from which appeals lie to the High Court as from original decrees, whether under the Civil Procedure Code or under any local or special Act, wherein the value of the subject-matter in dispute in the Court or before the Tribunal of the first instance does not exceed '[10 lakhs] rupees and wherein the value of the subject-matter still in dispute on appeal is 2[ 10 lakhs] rupees or less : provided, however, that the expression 'the value of the subject-matter still in dispute on appeal' appearing in this sub-clause shall be construed to mean, where there is an appeal as well as a cross appeal or cross-appeals or cross-objections, the total of the values of the subject-matters in dispute in the appeal as well as the cross-appeal or the cross appeals or the cross-objections;
Query: What do u mean by division court?
What do u mean by cross appeal & cross objection.
Can anybody provide me the pecuniary jurisdiction of bombay high court in original & appellate jurisdiction.

sir , plaintiff has file suit for parmanent injunction that
defandant obstruct the plainitiff from using the street on the westren side of the house of the defendant and plaintiff.
but actualy street in question is a private passessage left by defendant to enter into the his field. i have placed on record shajra aks(map in which street of the village is located)in which no street is find on the wastren side of the house.
i wants any judgement on this matter for considration on the application on order 39 rule 1 and 2

Dear Friends ,
By virtue of Andhra Pradesh state Inam Abolition Act 1955 (Telangana Area), can a Central Government Organisation becomes owner of an Agricultural Land; who has taken this particular land on LEASE from the Inamdar?
The Central Government Organisation says they are the owners, because they are in the position of the land on 1-11-1973 ( the vesting date, as per the above Act.)!

Additional and Assistant Judges.
1) Limitation act is not applicable for consumer protection act - Agnes d'souza case 1990.
Query : pls provide me the above case laws in PDF format & also tell me the list that which Limitaion act is not applicable to which ACT(S). Pls provide me the list of or tell me how to find out the limitation act is not applicable to the other act pls becasue i have heard that limitaion act are not applicable to many acts so pls give me the list or how to find that limitaion act is not applicable to that particular act.
2) Section 24(3) of the cpc.
24. General power of transfer and withdrawal.
(3) For the purposes of this section,-
(a) Courts of Additional and Assistant Judges shall be deemed to be subordinate to the District Court;
Query : 1) As per the above sub section can any LD members tell me the meaning, powers, authority, direction, advantages & disadvantages, qualifications to become the Additional and Assistant Judges they are having.
