Civil decree not executed for 12 years

Ld Experts, A civil decree relating to ownership of agriculture land was passed 12 years back but the same was not got executed.However, decree was not challenged by any one. After 12 years, When it was moved before Revenue Authority for updating the record, it was rejected as decree was passed more than 12 years back. Now what is the fate of decree. What is the process to get it re-validated? Thanks in advance.

Relinquishment of share

Hello All,

My Father Relinquished his share in the property. Actually there is a property of both our great grand father and grand father.

He didn't stated which one he is actually relinquish, the registered document stated that he relinquished the share for rs 20000, at that time I was not born, can I still have any rights to my grandfather's property or great grandfather's property.

Please help me regarding this.

do the person can execute the will of propeerty which is acquired by will of his father??

Without Prejudice.

The below matter has been said by the lawyer in our state to by client so i want to known the meaning of it & is there in our indian law system if yes than any case on it


In a Letter Or Notice if the above words are mentioned on the top of the Letter Or Notice.

"Without Prejudice OR With Prejudice Or
Privilege OR Privileged "

What it is the meaning of the Words if mention under the letter or notice.

I have heard that if any of this words are written under the letter or notice than it seems that it is not for the interpretation and also not for the legal evidence in the court.That the letter is not use for the evidence in the court & also cant interpreted it.

Also Pls Tell Me With Us Expert advice What do this words means & Can be Written Under any Stamp paper or affidavit.

Judicial serivce Vs Judicial Member.

When we called a member judicial member?

The answer was When any member appointed from the Judicial service (retired Judge or in service) is called a judicial member. So what does the judicial service here means?

We can say that any Judge under the law who is now retired but appoint under any tribunal or any quasi-judicial service are known as a judicial member. So here the word retired is compulsory should be there.

If the person has got a promotion form one level to another higher level under any quasi-judicial service than he is not a judicial member. Because he was not a judge & he is not retired from the judging work forms any court & not re-appointed under the quasi-judicial service.

Simply pls elaborate the term judicial service means & judicial member means. Support the answer with the case law of SC if any.

Fate of Decree / Order under Consent Terms ?

While I am in the process of filing Execution Petition in the City Civil Court , Mumbai for execution of decree / order passed by it in 2009 after filing of Consent Terms by me and the defendants a new issue has cropped up and worrying me. Two of the defendants and their family members are at loggerhead as one of these have broken in the room in possesion of other and thrown out their belongings resulting in filing of a private complaint in MM's Court as police did not registered the FIR. Their advocate has suggested that the MM may order sealing of the flat which is detrimintal to my interests as the flat is required to be sold as per decree / order passed in 2009.

Pl. advice:

a) If MM can order the sealing of the flat?

b) Will it affect Execution Petition that I will file after court vacation ?

Cheque deposit process

Hi,

We have received an order from High Court Mumbai to deposit some money in the name of Prothonotary & senior master, High Court, Mumbai.

What is the process of depositing the money ? shall we issue a cheque and send to them with a letter ? whats the address for prothonotary & Senior Master, Bombay High Court ?

Property matter

Hi ,my problem is that ,I have a property which I purchased in 1982 in my fathers name on G P A notary and my farther died in 1991 and all peoples are died who sell the property.After death of my father there requistment deed ( R D )maked in favour of myself through my SIX ( 6 ) elder sisters  Registered in tehsil .Now I want to mutation in my name , but patwari is saying that no record owner registry papers are there so he can't do. Pls help me and guide me which suit should be arise in law to make mutation EASIYER

Reference jurisdiction means

Difference between reference jurisdiction & territorial jurisdiction & jurisdiction? If we say that jurisdiction means the area under which a court can hear the case or can hear the case which are under this area popularly known as jurisdiction as per law so what do u mean by territorial jurisdiction? Also which court has testamentary jurisdiction &non – testamentary jurisdiction? Does city civil court has testamentary jurisdiction & non – testamentary jurisdiction?

TELEPHONE SERVICES AND CONSUMER FORUM

Now a days the Hon'ble State Consumer Readdressal Commission, Chennai and District Consumer Forum, Chennai are not entertaining new complaints against the Mobile Service Providers by relying the Hon'ble Supreme Court case General Manager, Telecom, versus M Krishnan.

According to my view, this judgement will not be applicable to the private mobile service providers in terms of TRAI Act 1997. Further the judgement in the case of Lakhbir Singh,the DISTRICT CONSUMER DISPUTES REDRESSAL FORUM, FEROZEPUR has clearly distinguished the applicability of the said supreme court judgement.

On account of the State Commission and District Forums orders rejecting the complaint, there are so many consumers are handcuffed and handicapped to fight their rights as a consumer.

Therefore I have decided to challenge the said consumer courts order by way of Civil Revision Petition before Hon'ble High Court Madras under Art.227 of Constitution of India on the ground that the State Commission and District Forum are failed to exercise jurisdiction and flagrant violation of law.

I Invite the vies from the members about the scope of the said revision petition
