A'S FATHER DIED MAKING A WILL WHEREIN HE TRANSFERRED HIS LAND FALLING IN LAL DORA IN PUNJAB IN THE NAM OF HIS SON. NOW SON WANTS TO TAKE LOAN FROM BANK BY MORTGAGING THE SAME BUT THE BANK IS ASKING TO GET THE SAME REGISTERED IN HIS NAME.
PLEASE GUIDE HOW CAN THE PROPERTY IS TRANSFERRED IN THE NAME OF HOLDER OF WILL IN CAE PROPERTY FALLING IN LAL DORA?
WHETHER MORTGAGED LOAN CAN BE AVAILED OF SUCH PROPERTY? IF SO WHAT IS THE PROCEDURE?

A LOWER COURT HAS GIVEN THE JUDGEMENT UNDER NEGOTIABLE INSTRUMENT ACT IN FAVOUR OF THE COMPLAINANT FOR Rs. 15 LAKHS AND 6 MTHS IMPRISONEMENT TO OPPONENT UNDER CRIMINAL JUDGEMENT. THE OPPONENT PARTY GOES IN TO APPEAL AGAINST THE JUDGEMENT AND REQUESTING FOR NON DEPOSIT OF COMPENSATION DUE TO FINANCIAL POSITION.
QUERY IS WHETHER OPPOSITE PARTY NEEDS TO DEPOSIT THE AWARD WITH COURT OR IF THEY DO NOT , CAN COMPLAINANT INSIST THE COURT TO ASK OPPOSITE PARTY TO DEPOSIT THE AWARD.
PLEASE PROVIDE THE JUDGEMENT OR SECTION DETAILS.

QUERY IS VERY SIMPLE BUT I WANT TO KNOW OPTIONS AVAULABLE TO ME.HOUSE IS REGISTERED IN MY FATHERS NAME.BUT MY BROTHER IS LIVING THERE FOR SAY 4 OR 5 YEARS.MY FATHER WANT TO GIVE THAT HOUSE TO ME.IF THIS IS THE INTENTION OF MY FATHER CAN I OUT MY BROTHER FROM SAID HOUSE.HOUSE IS SELF EARNED PROPERTY.WHAT LEGAL ACTION CAN I TAKE FOR DISPOSSING MY BROTHER.AND WHAT MODE OF TRANSFER SHOULD I APPLY IN ORDER TO GET THAT HOUSE INTO MY NAME.MY BROTHER WIFE IS ALSO TAKING BENIFIT FROM SAID HOUSE(BECOUS MY BROTHER & HIS WIFE IS LIVING RENT FREE IN THAT HOUSE AND CLAIMS BENIFIT WHAT GOVT PAYS THEM FOR RENT) IN MATTER OF RENT . Respected sir,
The schedule property was owned by Raj.After his death his son Mohan got inherited the same property.Thereafter there was partition among his family by entering into compromise decree in year 1977 before the hon'ble civil judge.
In the year 1980 mohan died and his wife seema acquired the property.Then seema and her son were in joint possession of the property till 1995.
In the year 1995 seema formed 15 residential sites in the schedule property and sold 10 for the benefit of her minor son.
The son after attaining the age of majority from the year 1999 his mother seema jointly sold the balance 5 sites.
After seema expired in the year 2010. Her son has now filed case against all the 15 site property holders.
In the above mentioned property's some of them have already constructed and some are under construction.
Now he is claiming that his mother have no rights to sell the property without consent of the son and also he's asking share of the sold property.
kindly request you to suggest to save the property.

It is one of the property dispute,the plaintiff had filed the suit before the hon'ble court dated june 1st 2011.As the suit argument is going on, again the plaintiff has filed the suit on same issue.whether it is legally correct?

Hi,
I have accepted an offer from one of the IT company and also signed bond, I have not got an appointment latter from this company and I left this organization within 8 days without serving my notice period.
Now company ask me to pay 2 month of salary and 50,000 as replacement cost as per bond agreement signed by me.
I have not received an appointment latter
Do I need to pay as per bond agreement ?
