Ad-interim order of injunction

I am constucting the house, yesterday I received an ad-interim order of injunction from alienating or in any way encumbering the suit schedule property or portion thereof.

What is the meaning of 'alienating'? Whether I can go on constructing the house?

Grounds on which mandatory injunction can be given

my brother encroached on my property, an unbuilt complete floor, made three rooms on it and was using it as aguest house without my permission.

my complaints to mcd, pgc for unauthoried construction were not needed.

I FILE A CASE FOR POSSESSION AND THE DELHI HIGH COURT DECREED RECENTLY THAT HE SHALL STOP USE OF PREMISES FOR GH AND PAY ME MARKET RENT FOR USE OF PREMISES FOR RESIDENCE , THE RENT BEING FIXED BY THE COURT.

THE ISSUES HAVE BEEN FRAMED.

1. I HAVE TO PROVE OWNERSHIP WHICH IS SIMPLE. THE WILL BEQUESTHS ME THIS PROPERTY AND IT HAS BEEN PROBATED BY DELHI HIGH COURT.

2. I HAVE TO ESTABLISH WHY I SEEK MANDATORY INJUNCTION AGAINST THE DEFENDANTS, BROTHER AND HIS WIFE FROM ENCROACHING ON MY PROPERTY.

AS STATED ABOVE, THE BROTHER, WITHOUT ANY INTIMATION TO ME HAS ALL ALONG BEEN CONSTRUCTION ROOMS ON THE SECOND FLOOR, 3 IN ALL NOW.
BESIDES ABOVE HE HAS WRITTEN NASTY LETTERS AND HIS WIFE HAS THREATENED ME WITH A WOMAND HARASSMEENT CASE, ALL OF WHICH ARE FILED WITH THE HIGH COURT.

KINDLY LET ME KNOW THE GROUNDS UNDER WHICH A MANDATORY INJUNCTION IS GRANTED AND WHETHER IN THELIGHT OF CIRCUMSTANCES NARRATED ABOVE THIS IS A FIT CASE FOR A MANDATORY INJUNCTION.

THERE ARE OVER A DOZEN VERY NASTY LETTERS WRITTEN FROM 1999 TILL 20003 WHICH ARE IN MY POSSESION BUT NOT FILED WITH COURT AS WE DO NOT WANT UNNCESSARY PUBLICITY OF THE DIRT IN THE FAMILY.

SHOULD THEY BE FILED TOO TO EXPOSE HIS LOW LEVER ACTIVITIES .

Loss of original will

under order 7 rule 11 of CPC should the plaint be rejected when hit by section 69 of the Indian partnership act when the plaintiff firm is not registered

G p a , if not mentioned!

Dear Experts,

In a registration document the GPA holder is not mentioned his status (As a GPA holder)but signed and registered the document . This had happened nearly 35 years back. Very recently this fact come out through a will. The story is Person 'A' is a GPA holder of Person "F". This person "F" through a will transferred the property to person 'B'. After the death of person "F" ,Mr. 'A' had taken a GPA from Mr. 'B'. But before the death of Person "F" person 'A' entered his name in Revenue records. Because of this reason , during selling of property Mr.'A's Not signed as GPA holder but signed as the owner of the property. This whole thing had happened in a family.

In the circumstances, what should legatee of Mr'B' should do? will the transactions done by Mr.'A' are valid in the eye of law?

Experts Sirs, please guide me with proper action to be taken to save my property!

Delay petition

I have filed a petition u/sec.5 of limitation act to file a main petition. conditional order passed on that delay petition that on payment of cost that petition will b allowed. I didnt pay the cost in time. hence petition dismissed for non payment of cost. now, can I restore the petition?

whether the PWDV Act has restropective compensation sustained prior to the enactment PWDV Act 2005?


can a complaint be filed against mother in law under PWDV Act?

can custody of the child be denied to muslim women under the act on the grounds of personal law?

can the petitioner clain residence orders in the matrimonial home which is owned by mother in law?

Distribution of land (ancestral)



sir my father died in 1967, and my mother in 2009. i have one sister, i am 45 years old my sister is 49. we had ancestral property of 40 acres land. i have filed a suit for my share in land for 30 acres land by hindu law in 2009. but court has denied and ordered for 50%.according to ammenmend in 2004-05. but my question is that my right was from my birth, and i and my sister were born before 2005.so partion should be according to 1956 HSA.
but court says that the suit was filed after law so the partion would be as of now provisions
so please clear my doubts
