Some laws like RTI Act 2005, Arms Act 1959 have provision for Appellate Authourity. What is the legal reason behind this provision in law? Is it some form of Constitutional requirement? Without Appellate Authourity will these laws become legally deficient in some manner?

Whether the claim is maintainable under consumer law if the bike is damaged due to burst or short circuit of battery, when the bike stand turned off?
If yes please send me case law on this point.

In a recovery case after the defendant filing the objection. wht is next action taken by the plaintiff lawyer. is the case proceed with evidence or the plaintiff lawyer has to file a counter statement of the objection filed by the defendant.

Mr. A has filed a WRIT to dissmiss order of Tribunal before highcourt aganist Mr. B and the said WRIT is dismissed at admission stage itself as too late(more than 35 yrs). can Mr. C who is in possession of property under B through agrmnt of sale take the advantage of said Judgment in a Injunction suit filed Mr.A aganist Mr. C. Mr. B is title holder of property which is in Mr.C's possession. Do the said Jdgment Bind on Mr.C though Mr. C is not a party in the said WRIT. But C's name is projected in the said WRIT memo. Pls advice

Does DRT has the Power to instruct the Bank to hand-over the surplus amount recovered under an action taken under Sec 13(7)of DRT to the owner of the property even if bank says there is a dispute over ownership of the property sold??

one my friend took loan 97500/* hdfc bank (delhi). paid 6 emi of rs.3550 each .but not paid since 2 yrs.blank chq given to hdfc used for full loan amt.6 months bank chq bounced & this month police arrested and to the court,bailed him. hdfc were agree to settle the loan for rs.50000/-,but friend is not in position to pay as he is small vegetable shopkeeper ,even can not hire the advocate.but he can pay the 500/- to 1000/- pm max 1 yr. how i can help him.any case references. may all of u suugest me procedures in which i may help him.

whole land was in my father name and possession after he expired , my maother and i is in possession, now i come to know that my father brother sons done all the land in his name through mutation entry , i file the case before Assistand commissioner case is dismissed ,on the ground the mutation entry is courrect and i was not brought the legal representative of the one respondent ,
than i filed revision before DC there also dismissed the case and said legal representative is mandatory ,
now my question is what could a take further steps to ,take my land back
these are all happend due to my ignorance me and my mother is illeterate ,help me thank you

During the pendency of case petitoner died leaving behind 4 male and 2 married daughters. Only male member comes on record as legal representative. Is this valid? Married daughters should also come on record as legal rep?

Hi All..
I have purchased 10 Cents of Land in Kerala (Trivandrum) with Bank Loan. All the documents are verified by the bank Lawyer including the reservay sketch. and my loan was approved by the bank.
After the registration I made boundary walls on the basis of my Title Deed and resurvey sketch.
(18 mtr front 22 mtr left side 21 mtr right side and 17.5 mtr back side)
Later my neighbour filed a case against me by saying that i have acquired his land. He is having 40 Cents of Land which is on the left side of my land.
As per his Title Deed also he is having 40 cents but the measurements in his Title deed is wrong, it showing 20 mtr front but in actual its only 15.5. In the Resurvey also its clearly showing that his front end is 15.5 meters and total area is 40 cents. If he getting 20 meters in front then then the total area of his land become around 44 cents.
The court designated a commission and a surveyer to measure the land and the commission had measured the land as per the resurvey plan and sumbitted before the court.
Now his lawyer requesting before the court that he need to measure the land again accourding to the measurement in his Title Deed (which is having the wrong measurement.)
his registration of land was happened on 1997 and mine is happend on 2008.
Please let me know some points which will give more importance to the resurvey plan.
right now i am in big trouble to maintain the case and monthly installments.

respected experts gud evening... pls suggest in the following matter
x presently residing in hyderabad. came down to visakhapatnam and borrowed amount from his friend Y by executing a promissory note in the presence of witnesses and went back to hyderabad. there he is doing job in a private company. he had relatives, household ration card and bank accounts at visakhapatnam. Inspite of repeated demands made by Y to repay the amount X did not turned up. How a suit can be filed and where it can be filed. What is the Jurisdiction ? Can X issue a notice from Visakhapatnam? with What ground ?
