Following a writ petition filed by a person in the High Court, the Court ordered the respondents to hold an inquiry pertaining to the case and to submit the status report to the Court within six weeks. The respondents have been named as Mr. A, B, and C serially in the Govt. authority in hierarchy. However, the inquiry was not conducted, and hence submission of status report was delayed. For the act of this omission, Mr. D who is not named as respondent has been implicated by the Court for the lapses and initiated a contempt proceedings. Though the cause of action arose within the jurisdiction of Mr. D's office (Head of office), neither has he been named as a respondent nor any directions received from his higher authority i.e. respondent Mr. A, B or C for holding an inquiry and to submit the status report to the Court on their behalf. As such, it is beyond my comprehension as to how come the Court has initiated a contempt proceeding against Mr. D. I request the Learned experts to kindly offer their comment on this.

On the instance of my landlord i made a substantial payment on behalf of my landlord to a Govt Department without any written agreement. The liability of the payment was of my landlord and i made this payment as advance rent for next 2 years as mutually agreed by me and my landlord and i stopped paying him any rent to him . I insisted to my land lord to issue me a receipt regarding the same but for some excuse or other he never gave me any Receipt. Within 1 year of making such a payment i issued to my landlord a legal notice regarding such payment and issuance of Receipt to me. My landlord duly confirmed the receipt of such a notice during his cross examine but never gave any reply to the same. After 2 years of such a payment my landlord filed a case against me for eviction on the basis of non payment of rent and stating that such a liability which i had paid was my liability and not his. During the case i can easily establish that the liability was his and not mine but -
1.Will the court agree to such an oral agreement between us.
2. Will the legal notice sent by us to him to which he as agreed to receive and to which he had not taken any action imply that such a payment was made on his behalf.
3. The legal notice sent to him was much before the institution of the case by him will clearly indicate that sending a notice to him was a not a afterthought and the genuinity of our intentions.
4. Do i have any chance in this case.
5. Are there any case laws regarding the issue of the notice as mentioned above and Implied/Oral Agreements which have Direct Evidence under the Indian Evidence Act. Thanks......

My case is fixed up for Arguments for the first time but i have found a very strong evidence in my favor over the Internet which will go to the base of the case and make my case strong and much easy to explain.
1.Can i apply for interrogatories now before the commencement of the Arguments.
2.As this can be termed as 'Discovery and Production' should it be applied under some different Order of CPC .
Thanks...

Dear all,
If an appeal hasbeen preferred against the judgement passed by the lower court and the first appeal is admitted by the High Court does it mean stay of execution of the decree passed by the lower court untill final order against the appeal is passed.
property
In the state of maharashtra,A and B had filed a suit at tahasildar's office against C for the want of A's title on the entire house property.Property bares all the above three names.Hearing was over and both the parties attended this hearing.
Hearing was over in April 2007 and decision was given in October 2007.Meanwhile A has made his "will" in July 2007,on this entire property in favour of B,assuming that A and B would win the case but were lost against C.
My querries.
(1)Is the "will" made by A is valid of the property which was in dispute at the time of making "will"
(2) Is this "will" valid when A and B has lost the case.
(3) If at all A and B had won the case, what would have been status of the "will" made on disputed property which was disputed at the time of preparing "will".
please let me have your guidence on each of the above three querries separately
