Mother's property

Dear Sirs/Madam

I have a property at Bangalore. This property was purely purchased by my mother
by her self earned income from BEL, Bangalore.

I am the only son. I do not have
any sisters or brothers.

My mother expired in 1986 without
writing any will or deed etc.,

In 1989 my father remarried. Through his second wife my father has a daughter.

In 2007 my father also has expired.

My father also has not registered /
made any deed in anybody's favour.

Kindly let me know about the present
devolution of the property.

My father's second wife (widow)and her daughter wants to sell the property
(which was purely purchased by my mother
by her self earned income)and take
50% of the value.

Is it right? Do they have right over
my mother's property.

Also kindly let me know whether
my father's second wife and her daughter can sell my mother's property?

Kindly clarify please.

Thanks and regards,

R.M.Asai Kannan

Receiving document

Sir,
I am defendant in Injunction Suit. Plaintiff filed Suit agnst me along with 4 documents in Sep 2010 and accordingly I have filed my wrtn statement based on the plaint and documents granted to me. After issue was framed and the matter was posted 'for Plaintiff's evidence Finally'(3-4 dates given before), the plaintiff files application(O VII rule 14(3), Sec 94(E)& 151) to receive documents(about 20 DOCUMENTS) ( main reason in affidavit are : 'thought that these documents are not necessary to produce while filing the suit'.,'Now his advocate suggested that these documents are very necessary in the above case', ' delay in producing the same is neither intentional nor deliberate, delay may be condoned')The matter is posted for defendant's objection. Sir my question is WILL it be fair if I submit my No Objection verbally only to receive and during evidence raise my objection about the relevancy, geniuses and binding of these documents while marking or should I object this application filing my counter to application saying not relevant, not admitted, not binding etc(based on the nature of documents) kindly suggest

Rent query with case law needed

1. That in this case A claiming himself to be landlord of a shop filed eviction petition against B alleging him as his tenant on the ground of arrears of rent. B disputed the relationship of landlord and tenant alleging that he never took the tenanted premises on rent from A and he is not in possession of tenanted premises and the alleged rent note produced by A is false and bogus documents and not binding on him. Despite denial of relationship the rent controller assessed provisional rent, interest and costs and the same was not tendered /paid by B to A. Thereafter without recording any evidence of A regarding proving of relationship of landlord and tenant the Rent Controller passed out rightly eviction order on the basis of a Judgment of Punjab and Haryana High Court, Chandigarh.

2. Mother of B claiming herself to be in possession of demised premises stating that her husband had taken shop in dispute on rent for the last 20 years and now he is untraced for the last one year and she is in possession of shop in dispute. She has further alleged that B is not residing with her and her husband and B has no concern with the shop in dispute and the eviction order is not binding on her.

3. Whether mother of B, not a party in the eviction petition under Section 13 of Haryana Urban (Control of Rent and Eviction) Act, 1973, can challenge the legality of Eviction order passed by Rent Controller in a suit for declaration alleging that the eviction order is illegal, null and void, without jurisdiction, against principal of natural justice.

Give legal opinion and authority, if any, for and against.

How to take possession

In a suit for title and Permanent injection for immovable properties based on a Gift-deed, the appellate court set-aside the decree of the lower court, and orders,

a) The gift deed in void.
b) No relief of title or permanent injection can be given.

Both the court finds that Plaintiff is in possession. If no appeal then,

1) How can the defendant take possession of properties?

2) Can the defendant pray for mesne profit for the period of wrong injection?

Thanks in advance.
