Property matter

my father have 5 siblings so total 6 children. 3 sisters and 3 brothers
Now while ancestral property division even sisters get the property?

I think there is some law which gives the exception that, the sister married before that particular year will not get the ancestral property.

Please through some light on this matter and if possible kindly provide with the year and law which gives exception.

regards
Sajjala

Surity liability

Sir
My brother signed surity to his friend on a Promissory Note for a loan of 3 Lakhs on 02-04-2002 and his friend paid interest to his Lendor regularly till Dec-2010 by endorsing on Pro-note and defaulted since Jan-2011 and my brother died in February -2009 after that my brother's self acquired properties have been settled between my brother's wife and his two children and completed mutation of properties on their names.Recently the Lendor came to our house demanded us to repay the loan with interest as my brother's friend is escaped and we are also unable to trace his address. Whether my brother's family is having any liability for this loan amount , If so what relief they can able to get under law because they suffer a lot to bear this liability.

Filling of 5 cents ofpaddy land for house construction

sir,
I am from KERALA
I purchased a paddy land in 2004.In 2007 I submitted a plan approval application to municipality for house construction.they asked me to produce the permission order from R D O to convert the land. As the wet land and paddy land act of kerala 2008 effected by then I approached the local monitoring committee for permission.as no reply from them received in next 9 months I sent a request to R D O. The RDO along with other members of the District Level Committee members inspected and met.{with the help of RTI i obtained a copy of the minutes of the Meeting of District Level COMMITTEE, Which says " 1.the land and nearby places are left fallow for 25 years
2.near by there is a 5 meter mud road adjacent to the plot
3.the applican can obtain permission by submitting the proof that he doesnot own any other land etc
4.there are new constructions under way to the adjacent plots who filled the land .As i went through the 2008 act I have the right to get permission if,
I dont have any other property in the same District and the conversion does not hinder the cultivation / irrigation of others.
BUT TO MY SURPRISE after 6 months i received a refusal LETTER of my request from the authorities.Informally I was told that I may NEVER get permission to convert the land because it comes under "THANNER THADAM" category.

Now my file is at the table of District collector in the form of an appeal?
what shall i do?
what all documents have i to produce before him if i was summoned by him?

Sale and registration of property

My brother-in-law has a residential property in Bangalore and wants to dispose it off. Though he has given me the GPA to sell the property, I am not able to do so now as the Supreme Court of India has now given a ruling that the GPAs should not be considered as a legal document for registration of properties from now on. That means the legal owner has to be physically present to complete the transaction at the time of Registration.

As my b-in-l is in the USA he is not able to be physically present. Is there any method by which I, on behalf of him, sell the property and legally register in the name of the buyer ?

I understand that a GPA endorsed by the Indian High Commission in the USA can be used as a legal document. Is it correct ?

Kindly advice as many such people are outside the country who may be in the same situation.

Affidavit of one of the witness of the will

one of the witness of the Will of my uncle has expired another is alive and the Will is not nortarized, not regd., nor probated it is only a typewritten will on the stamp paper with two independent Witnesses
therefore i want to take the confirmation of the one of the witnesses of the will i.e in relation with the genuity of the will, his signaure and confirmation that another witness has expired because tommorrow anything may wrong happened to this witness also therefore that document should be foolproof and valid in the court if any proceeding arise in the future therefore what type i should collect from the alive witness. whether affidavit before the notary is sufficient and is valid in the court or is there is any type of regd. document is there which he has executethat is 100 perecnt vaild in the court in his absence.
