Telecom & arbitration

Dear Experts,
Day before yesterday in a Delhi Consumer Court, the presiding member did not admit an matter against Airtel of some complainant, stating that now even the private Telecom Companies have to go for Arbitration...

Previoulsy, it was held only cases against MTNL and BSNL and that too landline matters, need to be referred to Arbitration.

So what is this the real current situation, any citation or reference on this subject would be appreciated ?

Arbitration, decree execution

OK so, A & B go to high court and come to a compromise, then an award is given, for a firm's property and business. Now A comes back to lower court and seeks execution of the decree as B is in possession of the property.

The lower court orders for a Hefty amount as court fee, and the court fee is incorrect as other properties being added to it were not part of arbitration, also that A actually has no means to pay for it.

In such a situation.

1) Will the decree execution set aside, will the High court award be null and void too?
1) What is the best solution for A to do now?

Regarding agreement-to-sell

Dear Experts,
An agreement-to-sell for an immovable property was entered into. As a part performance, the possession was handed over to the transferee and 90% of the settled amount has been received by him. The agreement did not contain any clause for the recession of the agreement by the transferor. It did not even contain any time limit for the full payment of the property to the transferor by the transferee; and the transferee is not paying the rest 10%.

NOW THE QUESTIONS ARE-
1) Can the Agreement-to-sell be rescinded by the transferor on non-payment of the settled amount;

2) If yes, since the agreement does not stipulate any time, how long does the transferor has to wait? Let me inform u people that a period of more than a year has already been elapsed by the date of the agreement..

3) I am confused with Section 53A of TP Act..is it harmful for the transferor at this stage.......does it really debar the transferor from rescinding the agreement?
