Under valued land sale deed: punishment

Party A signed an agreement in stamp paper with party B to sell his 10 cents of land at the price 3 lakh/cent. The registration document shows only 1.5 lakh/cent to save the registration fee.

The party B came to the house of party A and paid the whole amount on the date of registration, and B left to the registrar's office with registration document.

Then, there was a quarrel between the family members in house of party A on division of the money. The police came and seized the money and the agreement paper.

The police asked to produce the registration documents also in support of the agreement.

Now, the question is that the amount seized is correct as per the agreement in stamp paper but its more than the amount shown in registration documents.

So, should A admit that he deliberately prepared the registration document showing less value to save registration fee? What is the punishment for showing the land undervalued in registration documents?

Sir,
Kindly refer to my previous query in which CAT has issued directions to organisation produce the original records but the respondent counsel has not been furnishing the same despite of several adjourmnets given by the court and the court has given 2 times final opprtunity for furnishing the record..In the second last hearing he has informed the court that the records has been misplaced from the office and Cta has given another opprtunity to them failing which adminsitation action shall be imposed..In the last hearing the leraned counsel did not apper..
What I am saying that he has already taken 7-8 adjournments, and hon'ble court has been issuing the warnings but not action has been taken so far..In that case whether contempt petition can be filed for non complying the directions of the CAT??

Child custody after remarriage

Hi,

Im new to the forum however, I've been looking for the guidance in my divorce and related cases on this site. I have a question. My husband has filed for divorce on the grounds of adultry, he has some police records relating to that (the whole scenario of adultry was manufactured by him and hid lawyers). Following this I filed for DV and also police complaints as my husband and his family had started harassing me even more, which led to FIR where anticipatory bail was rejected at the distt level but was granted by the HC. The concerned SHO however was bought by my husband and has made a record that all my complaints were lies. The sucker has actually said it in so many worlds that i have lodged false complaints. Anyway, now after fighting a dirty battle for 1 year we are proceeding towards divorce settlement in mediation centre, I want to settle the matter for the sake of my son as he is really getting hassled by our fights and the legal battle. My husband wants me to sign on these 2 weird conditions in the settlement document:
1. If I remarry, I will pass on the custody of my son (5 years now) to my husband
2. If I go out of Delhi/NCR for work, I'll pass on the custody to the father.

Keeping all of the above in mind, what wud be my remedy in future if I remarry, as obviously I dont ever want to pass the custody of my son to his father. Will I be able to fight it out in the court and keep the custody even if I agree to the above condition now? He wont settle the case w/o me agreeing to the above term in the divorce settlement.

Please advise.

Legal way to own car park in mumbai

Now how does one buy a car parking alongwith flat and what is the document required(Mumbai):
1) will allotment letter from builder be binding on society?
2) Can builder take refundable deposit(not sale) and allot a car park/
3) will allotment letter/deposit slip be binding on society?

This query was asked earlier and it emerged that one way is to make it part of registered sale deed,however if builder does not own car parking space(i.e. not part od saleable fsi) will a registered sale deed be valid?

previous replies were not giving solution hence this repost

Registration of charge

Dear Members,

Whether registration of charge for immovable property by a company is compulsory under Registration Act 1908. Considering this that it is just as security for the bank? As far as Company Act, I Know it requires registration under section 125 of Companies Act 1956)

Further, Section 17 of Registration Act 1908 states that;

(b) other non- testamentary instruments which purport or operate to create,declare, assign, limit or extinguish,whether in present or in future, any right, title or interest, whether vested or contingent, of the value of one hundred rupees and upwards, to or in immovable property;

Kindly go through the above sub- section and post your valuable reply.
