Respected Sir / Madam,
I am hari from tamilnadu. My father donated ( gift deed) my mother’s property ( year of 2005 ) half of the line house to his own brother’s son.( 4 house = 1 line compound building ). I did not sign in my father donated deed. My father donates himself. Patricians was not made before giving the donation. My father without showing my mother death certificate and nominee certificate to conceder registrar office. My mothr nominee only me, no more son’s and daughter.
My father only document produced property tax receipt paid by him. My age is 23 when he donated my mother’s property. Now is 30 aged. My father did not get permission to me. I oppose this transaction. Still now I didn’t put the sign to my father donated deed. My father donation of my mother property without my knowledge. Now my father is alive.
Question:
1. Is it legal my father donation transaction? ( Gift deed )
2. Can I apply court to cancel of my father donation?
We are suppliers of process equipment in Mumbai. We supplied equipment to a party in Chennai. In the price to be paid to us an amount of Rs.3.0 lakhs is outstanding for more than one year. After sending so many reminders and telephonic talk, they sent the amount by 2 cheques. But when the cheques were presented at our bank, they were returned unpaid as the party had given “stop payment” instructions. We have now sent notice under Section 138(b) of the Negotiable Instruments Act, 1881, to the party asking them to pay up the amount within 15 days, failing which we shall proceed against them as provided under the same Section of the same Act.
Now if we have to file case against the party, can we file it in Mumbai, or have we to file it in Chennai only? In their purchase order, they have mentioned that for arbitration of “any dispute” the jurisdiction will be Chennai. But there is no dispute in this case. By sending the cheque, they agree that the amount is payable to us.

Regarding the lease
sir, if A has given the land to B for the factory purpose a certain land for 25 years and so that they made an agreement between them and they also defined the condition in the agreement that if any dispute arise in the future so they have to move to the arbitrator and they also defined in the agreement that after the termination of the term of lease they can renew such agreement.
After 25 years A had given the prior notice to B before the 6 months that we do not want to give the land for lease again and as soon as the period of lease expires you should vacate such property, Therefore B replied that we can't vacate such property and hence the suit filed by the A for eviction of such property. Now question arises that weather the A can give the notice before 6 month to the B(Tenant)to vacate such property on the other hand B replied that they should continue as a Tenant, he want such kind of relief. B also raise a point that the notice which has been give to him is premature and the civil court has no jurisdiction to try such matter bcs arbitration close is there in agreement is it right? or the civil court has the power to exercise such matter or notice need not to be given after expiry of the agreement, Whats your opinion sir.
