Rejection of issue framed

Issue has been framed by the court in divorce matter. After one year of issue framing, evidence not yet started due to various I.As. applied by both the parties, respondent has applied for rejection of the application questioning legality of issues framed. Can family court reject application without evidence? Whether such rejection application is admissible?

Right to sue

One of my friend brought a land in 1989 from Mani Iyer and his 3 son which is an ancestral property by virtue of Regd.partition deed in foavour of Mani Iyer in the year 1980. Now in 2012 another 4TH sons with a valid legal heir certificate issued a notice to my friend that he is having a part right over the property and hence he issued legal notice that he will file civil suit.Crl proceeding against all inclusing my friend. Now my question is whether after 12 years of sale whether he has the right to sue. BECAUSE the sale was executed by mani iyer and his three sons in 1989 but they have not said about the 4 th son.We came to know that till mani iyer was alive he never accepted this 4 th son as part of the family due to some family conflict and hence he made his self acquired property as a will to wife and three sons only in the year 1996. now he is trying to create the nuisance. Pl advice me on this situation.Mani iyer expired in the year 2007.

Recovery of money

a person running a shop to seel meat.he gave meat worth rs.30000/- without bill to some person on credit.
now that person acknowledged his liability to pay the amonut only to the shop runner.
the onle proof is this written aknowledgement.but in the written acknowledgement nothing is mentioned about the purchase of meat.only liability to pay 30000 is mentioned.

whether the suit for recovery has to be filed disclosing the purchse of meat or by only saying that the other person only borrowed 30000/-

Limitation for c.r.p. in i.a. judgement & order

Sir,

I have filed final proceedings and appointment of advocate commission for partition by metes and bound. I got 2/3rd share and my sister got 1/3rd share. My sister family made attempt to murder on me which is pending in the criminal court. My sister filed unregistered and unstamped relinquishment deed in the trial court for receiving the documents. I objected the same which were hit by Sections in Registration Act and Stamps Duty Act. While so I filed for appointment of advocate commission by filing I.A. the Hon'ble court allowed the unregistered deed and also allowed appointing advocate commission by relegating the documents to be considered at the time of final decree and objections can be raised at the time of final decree. Immediately I approached the Hon'ble High Court there the Hon'ble High court have not interefered with the order of the lower court in my Sister I.A. and confirmed the objections can be raised at the time of final decree. The lower court appointed advocate commission.

While so my sister waiting for nearly 5 months approached the high court by filing CRP in I.A. for appointment of advocate commission by filing additional evidence for refraining from executing advocate commission. Further the Hon'ble High Court order for completing the final decree proceedings within 3 months.

The question is when the primary documents are held in lower court my sister ought to have filed the same evidence in lower court. What is limitation for filing of C.R.P. in I.A. How many times a person can file additional documents in the court.

If on flimsy grounds and harassement when I am going to get justice already I have contested the case for partition for 17 years still I am not getting my legitimate share in my mother's property.

What are the options for me to get my share in my mother's property. Please advise and guide.

Thank you,

M.S.N.

Apt owners welfare association

1 Can a consumer case be made out a/g such association. It is collecting huge maintainance charges without proper justification. Also no water meters in individual apartments and water charges are huge and divided equally without regard for consumption.

2 inequality in car parking with some rouges usurping huge space in common area are claiming as their own

3 Also assoc. is blind to illegal occupancy in building without OC and is supping with fraud builder.

4 Also do we need to pay house tax if builder has put us in possession without registering flat in our names?

How do I get justice a/g these atrocities?

Thanks and Regards,
