I purchased a piece of land in Patna in 1972 of size 55 x50 ft. In front of the road there used to be a nala, which had been covered. During this period some 4 people raised mud houses encroached the road.Gradually more and more people started settling on it. In 1985, I lodged a complaint with Patna D.M. He had the matter investigated and ordered removal of encroachment.Due to laxity of the administration nothing happened and people continued settling on it. Repeated requests were made and again the administration promised to remove the encroachment and sent a magistrate to remove it but nothing happened . I filed a contempt petition in the Patna High Court and the court asked to the district administration to look into the matter and title of the encroacher before removal but again nothing happened. Instead my file was transfered to Jharkhand High Court in 2000, when the bifurcation of Bihar took place. This was instigated by a very powerful lobby , who on seeing people encroach themselves encroached at the other end of the land. I somehow managed to restore the case back to Patna High Court in 2001. The case reopened in 2011 .There were16 hearing of very frivilous nature. In all 3 judges heard the matter. The 2nd judge asked to disasscoiated himself from the case. Later the 3rd judge , who heard the matter dismissed the writ petiton on grounds that the essential parties were absent ie the encroachers. Is it my duty to serve notice to the tresspassers who number more than 60and bring them to court? The administration all along is saying they are encroachers and should be evicted. So instead of filing an SLP in Patna High Court, I have filed an S.L.P in the Supreme Court. My problem is this that it is very expensive to fight for justice there. For filing , I had to pay Rs35000/. For admission , I am asked to pay much much more. And for hearing depending on the number of hearing , I have to pay . This becomes absurd for a person like me who earns Rs250000/ per year. Can you people suggest , what is the best way out and is it wise to fight the case at all after examining the papers, I am sending as attachment.

Dear Sirs,
As i have acquired a property recently in bangalore, when i check the history with the original documents i came to know that in the year 1998 a natorized GPOA given to one person to deal with 25 cents of Mr.Sidappa property and that GPOA holder sold the property to Nagaraj in the year 2001 and nagaraj sold it to rajesh and then halid or sell to radhika from her i got the property. I got a doubt that remaining are sale deed. Only that Notarized GPOA in the year of 1998 is valid or not? If that is invalid then every thing is invalid? pl calrify my doubts,as some adv.friends saying that at that time in 1998 GPOA NOTARISED were accepted not an issue. some are saying there might be problems in any litigation by legal heris,pl advise me....

I have a house in sani gaon mount abu; I want to start a paying guest house in that property. I have applied for registration of paying guest house but since I have done that my neighbor and tenant started doing mental harassment on me and my family.
My neighbor who wanted to sell his house made complain about my property in court and filled case against me and even in RTDC department. I wanted to put tin shade on my stairs for protection of rains; he thereby complained in court that I am doing an illegal construction and filled a case against me. In RTDC department he complained about not giving license of paying guest house on my property. He mentally pressurized me to buy his house and to live a peaceful life we purchased his house even at double of DLC rates. He gave me memorandum of understanding for complains he made and withdrawal his case from the court. I wanted to take a loan on the property which I was willing to purchase from my neighbor but when I asked him for documents so that I could get my loan sanctioned he started ignoring me. I even gave him notice twice for making me documents available but he replied in notice with some unrealistic answer. When the agreement date lapsed I asked him to return me the agreement amount then he told me your agreement amount is forfeited.
He even left a massage for me from a third person who is mediator between me and my neighbor that “ tell them to buy my house else I would complain about them in income tax department, sales tax department and many other department. We would make such complains that they would have a huge losses in their life”. We are ready for investigation of any department and even ready to pay fines and penalty if we are in default but not on the basis of his complain. He is mentally harassing my family for purchasing his house. I even sacrificed my profession of chartered accountancy because of my family financial conditions. To improve my family financial conditions in decided to run a paying guest house in that property.
My tenant who recently lost a case which we filled against him for vacating our premises in civil court of mount abu ; even he started harassing us by support of my neighbor. He is expecting a lump sum amount to vacate the premises but we don’t have so much money to give them.
My father is a heart patient and even my mother came in depression with all such harassments. So I kindly request you to take some appropriate actions against my neighbor and tenant. If due to such harassment anything happens to my family or I say to my father or my mother then these people would be liable.
tell me what action i can take against him.
thanks in advance.
