Experts,
Iam told lower courts do not act against their orders which are breached. I filed an application for contempt u/o 39 R (2A) and Section 12 of the Contempt of Courts Act. Defendants were ordered to reply within 4 weeks. No reply received for many months nor court has initiated procedings against the guilty. What should one do in addition to moving another application for deciding the matter??? Any advice. The matter is pending.

CA of respondent (orig pltff) filed affidavit 3 months ago without producing power of attorney. A new Advocate was appointed 3 months ago but vakalatnama was not filed. Appellant (orig.defendt)demanded copy of POA and inspection of original, which was not complied with. 3 times in last 3 months advocate sought adjournment to file vakalatnama bu not yet filed. My questions are: a. Can the court consider the affidavit without POA ? b.is appellant entitled to copy of POA and inspection of original ? C. Can new Advocate continue to appear without filing vakalatnama ? D. Any case law on the subject ? Kindly advise.

Dear All,
I had taken a mobile phone 10 years back in 2002 and surrendered it with 3 months (ie. in 2002 only) as the services (connectivity etc..) was very poor. I recollect clearing all the dues with the mobile company.
Recently, about 10 days back (ie. in 2012) I get a notice from the Lok Adalat asking me to pay Rs. 4000 for amount due on this phone. No further information is provided as to which month's bill is pending etc...
My questions:
1) Can the mobile company, out of the blue, sue me for any amount after 10 years. Does the matter not become time barred after 3 years. During these 10 years I have not got a single communication from the mobile company.
2) Can a Lok Adalat notice come on just one page with no information at all except a mobile number (which they say I had) and the alleged outstanding amount? Can I demand further details for this amount?
3) The lok adalat notice has a slip (unsigned)attached to it stating 'important notice'. This slip-notice (just a small piece like a post-it) states that if I donot pay this sum of Rs. 4k then proceedings u/s 406 and 468 of IPC will be initiated which are non bailable offenses and any opportunity of hearing will be only post obtaining a bail !!!
4) Can I sue the mobile company for damages on account of cheating and frivolous complaints filed against me which is harmful to my reputation. If yes then which sections will be the most effective and howto proceed against it?
Thanks a ton in advance.

Dear Experts,
My bedridden mother was very old 93 years old. She had a competency issue, somewhat illiterate and only life interest in the property and has passed away recently.I as plaintiff had filed a suit against her to declare a public notice as "null and void "in which she had disowned me from the property even though she had no title and only life interest.Originally it was my father's self acquired property. Iam now the owner of my share in the property after the sad demise of my mother. This public notice was engineered by my brother who was not content with his share in the property and wants to/wanted to usurp the whole property. The suit abates because my mother(defendant) is no more . Any application under CPC from any LR is awaited till next date and no substitution Ibelieve is possible since cause of action cannot be exercised by any other LR. Now my question is
a) Can I still take the plea to declare public notice as null and void because it is being misused.
b)How to stop misuse of this public notice since my brother is malafidely submitting it to various departments and authorities.
Thanking you all most respectfully for the best possible advice.

In a Vocational Trainin Centre running by a Govt deptt, they employ some employees on contract for 1 year. But as per (Standing Operating Procedure)SOP of that Vocational Training Centre, an employee should be employed for Min 3 years on contract & max 5 years. The administration can't renew the contract, but every year they appoint new incumbents after lapse of 1 year contract. They signed a contarct for only 1 year, without knowledge of the employees who are appointed that SOP says contrsct should be on Min 1 year. Is the adminisration go againt the SOP, what we have to do againt this?
