Without pleadings defense cannot be taken.

In my client's case defendant has filed written statement but he didn't enter the wittness box. The suit came to be decreed. After that he filed RA. The Appellate court remanded back the suit to the trial court for defendant's evidence. Now defendant has taken contention that he is the owner of the suit property by way of gift deed. This contention was not at all taken in the written statement. In my opinion without pleadings in the written statement now defendant cannot rely on the document.
Dear members any supreme court rulings please upload the same.

Succeeding month ...

In an order it is written that - "Rent has to be deposited month by month by the 15th day of each succeeding month ".

Does this means rent to be deposited by 15th of the next month. e.g. Rent for the month of June to be deposited by 15th July.

Thanks ...

Share trading account money

Hi Experts,

I need legal advice for the below:
I am facing an issue of share trading account money in my deceased father's account at Karvy stock broking ltd. The demat account had the nominee and the shares were transmitted to my demat account. But the amount of money in the trading account which is interlinked to the demat account is not yet transferred to me. When I contacted Karvy with regard to this they ask for a succession certificate. Karvy is not ready to share any circular/ policy document from NSDL or Karvy internal. I would like to know why a succession certificate for an account that is linked to the demat account with nominee details registered. Its been more than a month that I have submitted a claim to the money. I stay in Hyderabad and will be grateful to the legal experts

Thanks in advance!!

Supreme court listing

I have got reply from efiling of the supreme court which says

"YOUR PETITION D.NO _____ HAS BEEN REGISTERED AS SLP(C)..CC NO _____ AND THE SAME IS BEING LISTING FOR HEARING ON _____"

Does the above mean my case has been admitted as cc no has been given.

Earlier I had filed an connected SLP which was odered as follows
"permission to withdraw slp in REV Appln________ permitted and the petitioner seeks permission to agigitate the matter in CRP____. Permission granted.

Therefore I filed a fresh SLP and I have got the above reply from the efiling dept. let me know whether CC means case has been ADMITTED or NOT.

Partition deed

Good Site and very help full thanks to all the contributors and members.

Need some advise and expert suggestions to help solve my problem.

My Grandfather had 21 Acers of land before he expired in 1991. He lived with 2 sons, 3 daughters and 1 wife. Of the 2 sons my dad is elder. After his expiry his younger son worked out with sarpanch and other MRO officers and created 3 passbooks with 6.5 acers for him, my dad and my grand mother. Although we objected this and informed the sarpanch there was no action taken to resolve the same. Later in 1995 he and my grandmother sold 1 acere of land and the same time without her notice he got the other 5 acers of land registered to his second wife and sold the rest.
all the above sale transactions were done without our or anyone's notice.

Now my aunts are asking land and also there is no partition dded signed.
Request to please advice on how to solve and sort the issues ..

Adverse possession

Experts,

Basappa and Remesh are full brothers. Basappa went in adoption to another family when Ramesh was minor. Basappa was looking after his genetive famiily also. The ancestral house property submerged in river project. Village was shifted to now town. Panchayat was granted a plot in the name of Basappa instead of Ramesh. House was constructed. Both were started residing in the said house. After the marriage due to women folk in the family, house was divided in to two parts. In one part Ramesh and in another part Basappa started residing. Doth parts of the house standing in the name of Basappa. But elecric bills and pancyat tax of his part, Ramesh is paying since 20 years. On that ground, Panchayat has entered the name of Ramesh on his part. Basappa channaged the name of Ramesh. Subsequently Ramesh filed a suit for Adverse possession.

Waht are the conseequences of the suit.
