Hello,
I found this website very useful and thus posting a query the answer to which has been perplexing me.
I am newly enrolled lawyer. My client filed a suit in trial court for injunction but the same has been dismissed by the court under Order 7 Rule 11 for non-disclosure of cause of action.
The question I want to ask is should he file a revision or a writ petition in the HC. Please help me on this.
Thanks

hello sir
my uncle (deceased on August 2012)and he was a government servant. he has property in his native and in Bangalore. But the property in his native is in his brothers name. my uncle registered it in his brother's name. my uncle is having 3 brothers. In white plain paper he wrote saying that the property in the native would go to all three brothers in future. and all the brothers agreed and signed in the same paper. But is this paper be valid. as my uncle is not living, can we take this as evidence if any issue arise in future and partition the property.

A mutual unregistered Panchanama written on a ordinary paper in the year 1987, reflecting the partition made between the brothers of the defendant, which is in the possession of the defendants. The petitioner is the person who purchased a piece of land from one of the defendants. The petitioner is basing his case on the said panchanama and other documents like sale deeds mutation order, land revenue paying receipt etc. All the defendants who are brothers are not disputing about the panchanama. Only one defendant who is NOT the brother of the defendants claims to have purchased the said land much before the petitioner, disputes the panchanama.
My question is
1)Since this is a document which is in the possession of the defendants who are brothers and they are not disputing the photo copy, in that case is it necessary to produce the original panchanama before the Court.
2) The defendants does not want the said panchanama to be given to the court, because they think it will be damaged while keeping with the record, but they are ready to show it to the court once. Whether an attested copy of the said panchanama can be accepted by the court. UNDER WHICH SECTION AND LAW IT IS PERMISSIBLE.

we, two brothers, will get the immovable through a WILL executed by our paternal grand mother. As per the WILL, the property will be on my mother's name with only limited rights of enjoying the premises and with no selling rights. She is hale and healthy as on date. After her, the property will be on our names with full rights of enjoyment, sale etc.
Now, we three, would like to promise on paper a certain amount of cash to my sister from the proceeds of the immovable property when we sell it or go for development. What is the legal method for this ? Is it enough if we three sign such a paper ? we, two brothers are married and have major children.Kindly clarify.
Thanks for your prompt answer. In addition to what is written above, I would like to submit the following for your kind consideration and advice.
My mother being 82 year old, she would like to see a kind of commitment on paper from her sons that they would part with some share in the immovable property in terms of cash to be given to my sister at a later date. We are agreeable for such a commitment to saisfy my mother. Can we execute any document for a fixed amount of cash without specifying any dead line for time ?

except the family kiths and kins i got it that its benami if u buy in anothers name.but when a father buys property in the name of child, what is it,HOW WILL COURT INTERPRET IT.I WANT TO KNOW JUST WHAT NAME COURT WILL GIVE TO SAID PROPERTY.I AGREE FATHER TO SON IS NOT BENAMI BUT WHAT IS THE NAME OR STATUS OF THAT PROPERTY IS?
NEITHER IT IS GIFT,,I THINK IT REQUIRES CERTAIN WORDS LIKE LOVE N AFFECTION.
NEITHER IT IS RELEASE DEED OR ANY OTHER KIND OF FAMILY SETTELEMENT.
ONLY THE PROPERTY IS JUST PURCHASED IN THE NAME OF SON AND NOTHING BEYOND IT AND TODAY WHEN THE PROPERTIES RATE ARE HIGH AND ALL FAMILY NEED IT, SON IS DENYING TO GIVE(NOT EVEN A SHAARE OF IT)
MY ONLY QUESTION IS WHEN HAD NO MEANS,NO RESOURCES, NO MONEY HOW CAN THE SON PERFECT HIS TITLE ON IT.MERELY THE NAME FIGURES OUT ON REGD DOCUMENT IS SUFFICE?
IF THAT BE THE CASE I WOULD LIKE TO INTO DEEP AND INQUIRE HOW HE GOT THAT MONEY TO PURCHASE THAT PROPERTY.
IF SON FAILS TO SHOW IF HE TRIES TO PROVE IT THAT HE HIMSELF PURCHASED IT AND HE FAILS IN IT, WHAT WUD BE THE FATE OF THAT PROPERTY.
PLZ PROVIDE A RELIABLE ANSWER WHY IT CAN NOT BE STYLED AS BENAMI,ON WHAT BASIS SON HAS GOT TITLE,MERELY BECOZ OF NAME ON REGD DOCUMENT.
DONT WE SEE SOMETHING IS WRONG IN IT.
PLS TAKE INTEREST AND GIVE AN WELL THOUGHT OUT ANSWER SO THAT I CAN DIGEST THAT REPLY.

if we were allowed to produce a document we could have won the case but hc dismissed appeal with no cost and concurred with lower courts judgemennts.should we file slp or a declaration suit.what is this declaration suit and how it can become a substitute for SLP(some lawyers suggested me).
my question is what is this DECLARATION SUIT and is't it a new suit? will the lower court court allow it to be filed?
matter -- a person is continuosly sending rent to A for more than 30 years and now the B(municipal body) is contending that it is muniicipal body's land.SOME GAZZETE NOTIFICATION WAS NOT PRODUCED EARLIAR.IN THAT GAZZETTE NOTIFICATION THE DISPUTED LAND BELONGS TO US.HAD THAT DOCUMENT BEEN PRODUCED IN TIME,SITUATION WUD ALTOGETHER BE DIFFERENT.
some lawyer suggest me if u file dec suit court will seek that document theirself and suit may be maintable.
plz enlighten me thanks
