A civil suite(filed in sep 2011) is in progress in a trial court between two persons regarding ownrship of a plot of land . Court ne temporary injunction kiya hua hai ... sabhi pakshkaron ko "YathaStithi" banaye rakhne ke orders note sheet par likhe hue hain. TI har date par extend hota chala aa raha hai.
Vadi achanak ek deed register karata hai jisme wo ye kahta hai ki old age ki wajah se wo apni property (indicating the disputed land) ki dekhbhaal nahi kar sakta , isliye wo apne kisi relative Mr X ko is property ka Mukhtar-e-khaas bana raha hai aur use ye rights de raha ki wo jaise chahe uski property ka istemaal kare, even use sale bhi karne ka right wu us Mr X ko de deta hai. Sath hi ye bhi likhta hai ki agara koi muqadma us prperty par kisi bhi court me chal raha ko to usme Mr X uski taraf se pairvi kar sakta hai uski jagah sighn kar sakta hai.
Please tell....
1) Jab TI hone ki wajah se Vaadi hi ko disputed land bechne ka haq nahi hai to kya uski is tarah likhi hui deed legal hai?
2) is it contempt of court's order of "Yathastithi"
3) what shld respndnt do.... a) lodge an FIR against vadi , or b) file a suite for deed cancellation , or c) file contempt case

Renowned 82 year old historian Sri:M ChidanandaMurthy decried (press conf.),the announcement by Rehman Khan (central Minister)of establishing a Tippu Sultan University atSrirangapattinam.with 50%reservationion for Muslims. He stated that Tippu was one of the most cruel despots the country has seen and massacred thousands of Hindus especially Nairs of Kerala.I am 67 year old and havestudied in the history books in the 40s and 50s confirming the same .He has given elaborate evidences to prove thatTippu a fanatic, hated not only Hindus but set aside Kannada and encouraged Persian .One can even see today inscribed on the main door of the mosque at srirangpatna (which was a temple earlier)that no stone should be left unturned to destroy all Kafirs. There are other evidences available. The Police have filed a case against Sri: Murthy based on a complaintby muslim member of Tippu Sultan samyukta ranga. Can Court set aside Truth just to satisfy a community and to maintain so-called communal harmony and punish Murthy?

dear sir
In our mhada society, the old 4 floored building was extended with 3 more floors. I have purchased flat in new floor. However old society has not yet accepted us as members since building has not yet got O.C., builder has given us possession of flat, Also, maintenance they charge us is almost 3 times of old members. The reason they give us is that MCGM charges property tax of new flats at higher rate than old flats. However, MCGM gives a single bill of property tax for entire building and not for individual flats.
Is society right on their part. they can charge more property tax then old member and they can refuse our membership on non o.c.ground? please advise us, thanks

I purchased property (in Goa) in feb. 2012,
before I purchase the seller "x" gives POA to one "y" (with a power to the seller to Sub-delegate his power even to sell) where by "y" now sub-delgt his all power along with sell power to one "Z" and now "Z", now "Z" sold to me that property. (even registered before sub-reg.)
mutation my name entered also .
now when I put it for partitioning before dy. Coll in sept. 2012, the Dy. Coll. said it illegal to Sub- delegate power (even if there is a power to sell).
therefore he (dy. coll) asked me for a case laws where it has happen so.
my Q is :-
1. under what law the dy. coll can ask me this.
2. is it correct what dy. coll says.
3. is my buying is illegal wrong even if sub. reg. registered and mutation takes place.
4. is there any case when such have happened, or when I can support my appl. and give that dy. coll. the said case law. pls can help me.
thankyou.
Respected Experts,
I filed a debtor Insolvency Petition on behalf of my client in the year 2003. The same was allowed adjudicating my client as Insolvent in the year around 2006.
My client/insolvent applied for a passport recently. Police people denying to given N.O.C. on the ground that he is not entitled for a passport for being declared as Insolvent. Order copy of I.P. was also supplied to the police. Though, he never involved in criminal case, police are not willing to issue NOC.
In spite of my thorough search, I found no where such a disqualification for an Insolvent except for contesting local elections etc. under Insolvency Act.
Pls clarify my doubt "whether an insolvent is disqualified for a passport?"
Pls advice me what is the recourse in the above situation?
Thanks in advance.
Original suit dismissed in sessions court
I am the plaintiff in the original suit and the suit is based on equitable mortgage by deposit of title deeds, but now the judge has dismissed the case.. and I am in process of filing an appeal in HC, but now the defendant armed with order of dismissal is trying the sell the property... 1) can he sell the property before the appeal period? 2) what remedies do I have to prevent this?
