r/sir,
under Order 39 rule 3a, copy of interim order required to deliver/ send to opposite party or only copy of application for injunction together with 3a i, ii, iii required to deliver/ send to opposite party.
in a civil suit plaintiff serve defendant only copy of plaint along with copy of application for interim stay, and no interim order, affidavit in support of application,or copy of document serve to plaintiff, now these facts enough to vacate interim order against the defendant.
I had sent a legal notice on 10.3.05 for the total amount to be paid to me along with accrued interest failing which to dispose the land for which title deeds have been given to me by equitable mortgage. The property details was also provided
But in the legal notice I had not mentioned the date when this deposit of title deed had been made and place at which where it was given to me..
but in plaint filed on 30.03.05 all the details were given along with the property details.
But the judge dismissed the mortgage part this by saying that I have not provided the date and place of mortgage in legal notice and povided this for the first time in plaint filed.
Is the position taken by the judge correct?
if not correct the relevant provisions of CPC or judgments to help me.? Should every minor detail as in the plaint should be disclosed in the legal notice also?
Is it mandatory to send legal notice to the defendant before filing money or mortgage suit.?
If it is mandatory than under which section of C.P.C?
If not mandatory than under which section of C.P.C, ?
Any relevant citations in this regard?
Impounding an unregistered and forged document
Sir,
What is the result for unregistered and forged document impounded for stamp duty. The litigant holding the unregistered and forged document can become valid and legal after paying penalty and stamp duty. Can the litigant will hold title or interest on the suit property by merely paying stamp duty even though it is forged document.
Please kindly advise.
