Dear All,
In Jun 07 my father met with an accident. In Apr 12 we had gone for "Out of court settlement". We have been sactioned Rs.5,00,000/- as a compensation.
Our lawer is Mr. A, through him only we had gone for this out of court settlement.
During the case argument, Mr.B argued for our case instead of Mr.A though Mr.A was there. In presence of Judge and Mr.A, we told Mr.B that he should not argue for our case because Mr.A is our lawer. As we said Mr.B kept quite and left that place immediately after a while. We only argued and won the claim of Rs.5,00,000/- though Mr.A was there with his mouth shut.
We were sanctioned the compensation in Apr 12. Till now we have not received our cheque. When enquired Mr.A he said that cheque will be issued in the name of my father, we need not have to worry.
Several monts went on like this, last week we again asked him, he said that cheque is ready but we need to talk to Mr. B to finalise the percentage as a lawer fee because Mr. B only did all the works to finalise the case.We said to Mr.A that you are only our lawer, but he is not agreeing and keep on telling us to contact Mr.B.
Whenever I make a call to Mr.A's cell phone, he attends the call but never answer back or gives it to his kids.
I am afraid that if I speak to Mr.B, he may demand more percentage.
Even if I put pressure on Mr.A, I dont know much much percentage he will ask.
(I did not initially agree/discuss any percentage/amount as lawyer fee)
I don’t know what to do next.
My queries are as follows
1) What is the average percentage is collected by the lawers as a fee on accident compensation?
2) How to handle/deal with Mr.A?
3) Is it right to talk to Mr.B?
4) If I talk to Mr.B and If he demands more percentage, then what do I have to do?
I don’t know what to do next. I am totally confused.
Please help. Request your advise.

According to the current Khatauni of an agricultural land, Mr A is one of the ten owners enlisted ( as owners with transferrable rights ). Mr A brings a civil suite against one of the cosharers praying permanent injunction and submitting court fee accordingly, in his plaint he says that he is the sole owner and submits some documents ( a sale deed etc of 1930 ) in his favour. Thus while acoording to current RoRs he is not the sole owner, he by his plaint indirectly wants relief of declaration from the court. In this case can the respondant bring the point that plaintiff should submit court fee based on consequentional releif of declaration.

Where to complain against the Co-operative Hsg Soc. authorities if they do not accept the written notice? What are the other options available if the society refuses to accept any written notice from a society member? under which section of the MCS act this matter of non acceptance of the written notice falls?

Sir,
Our flat/Apartment situated in Vadodara Gujarat. There is an Act The Gujarat Ownership Flats Act 1973, means any apartment/Flats constructed in the state of Gujarat have to follow this act and as stated in the act members/owners can form Association from the flat owners and hence bylaws which is to follow by all the owners/members.
My question is that if there is an such ACT is existing than what is the necessity of registering the Owners Association? As the sale deed made and register under this act in the office of sub-registrar by individual flat owner. Than why we go for registering the Association either under co-operative housing society or Service Society?can we assume that our apartment is already registered and hence the Association.
If your answer is register the Association than why such Act are made for?
Please give answer in detail Sir.
with regards.
Thanking You.

my friend is very irritated by the recovery agents of the bank. though there is a dispute over the loan agreement and the matter is currently subjudice & though he has already instructed the recovery agents and their respective banks not to visit him at home and instead to meet him in his office at the specified timing , the recovery agents keep coming to his residence and harass his family members in his absence. So, He wants society security persons to stop the recovery agents at the entrance and not let any body into his residence. For this he has kept the letter with the security persons stating the specific time and the address of the specific place to meet him personally as per to the Banking Code of Conduct. Can he ask the society authorities to instruct the Security persons of the society not to let any recovery agent into his flat to meet him ? If the society authorities refuse to accept his written request for not allowing any recovery agents of the bank to his residence, what action can be taken and Where to complain against these rogue co-operative Hsg Soc. Authorities , who do not co-operate with him?
