My brother applied for letter of administration of my father's will and no one challenged and the court has passed its judgement about six months back. He is not taking any effort to excute the will nor initiate to regularise the affidavit ALREADY SIGNED BY US. we signed two affidavits drafted by a lawyer about 16 years back before he applied for letter of administration and we are enjoying the property as per that.
He has applied for letter of administration to the court and got it in his favor preventing the other benifiries from disposing the properties by keeping silent not even informing the benifieries about the court order nor initiate any action
What is time limit given to the administrator/ does it not amount to contempt of court directive. can we remind the court about this.

Hi , we are two sons . my elder brother is settled in states and my mother wanted to give a plot of 200 sqyds to me which is self acquired by her not inherited . so she did GPA CUM SALE on my name which is registered by paying stamp duty for the above transaction applicable at that time,in the sub - registrar office in the year 2004 and my mother purchased in the year 1995. the E.C shows both my name first and my mother's name second .the words on the head of the document are
AGREEMENT OF SALE CUM GENERAL POWER OF ATTORNEY
We live in hyderabad and GPA CUM SALE is very much valid here as one document , which essentially authorizes the VENDEE (me) as GPA holder and at the same time gives the right to SELL the property to others either in full/partial on behalf of the VENDOR and there is no time clause in it . the plot is coming under buffer zone of lake FTL i mean the place which has to be left free and no construction can take place but we can go for compensation and it has been given either in the form of cash or alternate plot . Compensation will be released in the name of title owner . so here who is title owner me on whom there is a AGREEMENT OF SALE CUM GENERAL POWER OF ATTORNEY registered document or my mom on whom the SALE DEED is there . i have these set of questions .
1) CAN REGISTERED GPA CUM SALE HOLDER (me) ELIGIBLE
, RECEIVE GOVT COMPENSATION ON HIS NAME . IF SO WILL
THERE BE ANY REQUIREMENT / NOT OF ANY NOC'S
EITHER FROM MOTHER AND BROTHER WHILE AT THE TIME
OF RECEIVING COMPENSATION .
2) OR SHOULD I AGAIN GO FOR SALE DEED ON MY NAME .
IF I HAVE TO DO IT SHOULD I HAVE TO CANCEL THE
EXISTING GPA CUM SALE AND AGAIN GO FOR SALE DEED ON MY NAME .
3) IF I HAVE TO HAVE SALE DEED ON MY NAME, CAN I DO
IT NOW OR IS THERE ANY CLAUSE AS SUCH THAT THE LAND
SHOULD HAVE BEEN ACQUIRED BEFORE SO AND SO YEAR FOR
AS PER ANY LAND COMPENSATION ACT .
THE NEW LAND ACQUISITION AND COMPENSATION BILL HAS
BEEN RECENTLY CLEARED IN PARLIAMENT . HOW SHOULD I
PROCEED IN THAT PURVIEW . PLEASE HELP ME OUT ....

My Father has four brothers and all were leaving in joint family till year 2001.He is third one. During joint family live in the year of 1971 they purchased some lands and registered on younger brother's name. Unfortunately younger one has died in year of 2000. Now younger one son's are saying those purchased lands are theirs and no rights to other brothers of the family. Now the case is pending at District Civil court.
My questtion is, can other brothers will get share of the said lands equally? or how to proceed to further to get justice?
advanced thanks for your replies.

My Society had 42 flats and 17 shops . A and B wing comprising of resident members having separate entrance . Shops are on the main road side with separate entrance . In that sense my society is divided into 3 parts : Wing A , WING B and Shops which do not come under any wing. Lifts are in Wing A and Wing B and Shop owners do not have any relation to lifts as they do not enterthe resident part or use lift . Whether lift charges are applicable to Shops also

My father & father brother both are Joint Family for last 40 years, recently they divided , before divided they divided property too(1 year back),
My father given some property as gifted to my father brother, at same time my father brother given some property gifted,
It’s completely registered(sale deed done) as gifted property at Sub register office guntakal
Now my father brother asking revert back gifted property & also he cancelled gifted property at Sub register
Is it possible revert back? & when we check with Sub register office they said it’s possible to revert back as per there rules.
As per above article I can see or “A gift can't be taken back: SC” as per supreme court order.
Question
A gifted property reverted back by sub register office Is it valid?
If we go to court , before that donor canceled gifted property, if he sell to third party, is third party sale deed valid?
After third party sale deed done, if court given notice to whom we need send notice i.e. Donor or Third party or sub register office or all?

A;B AND C ARE THE CO-OWNERS OF THE COMMON ANCESTRAL PROPERTY IN WHICH TWO WELLS ARE THERE. THEY HAVE PURCHASED ANOTHER LAND IN 1981 AND THEY HAVE IRRIGATED THE SURPLUS WATER TO THE PURCHASED PROPERTY FROM THE DATE OF PURCHASE. IN 1999 THEY HAVE PARTITIONED THE PURCHASED PROPERTY (WHICH IS PURCHASED IN 1981)AND IN 2002 Mr.A SOLD HIS SHARE OF PURCHASED PROPERTY AND HE SEEK STAY PETITION FOR NOT TO IRRIGATE "B" AND "C" TO THE PURCHASED PROPERTY
MY QUESTION IS "WHAT IS LAW POSITION FOR IRRIGATING WATER FROM COMMON PROPERTY TO THE SAID PURCHASED PROPERTY"
HERE "B" & "C" ONLY IRRIGATE THEIR SHARE OF SURPLUS WATER TO THE PURCHASED PROPERTY.

A title suit for declaration of right and title was filed by the Plaintiff against 4 claimants to the suit property declaring them as the defendants. Three out of them were set exparte for non-attendance and non filing of written statements. One of them contested. Owing to the negligence of the plaintiff's lawyer the suit was dismissed for default. Plaintiff prayed for restoration of the suit in a mis-case by adding the L/Rs of two deceased defendants( who passed away in the intervening time). The suit has been restored to file. The total number of defendants, including 2 from the original suit who were set exparte in the mis-case numbered to 18. Only one of the 18 present defendants is contesting--who is the L/R of a deceased defendant. The original defendant was the mother of the contesting L/R, who was already set exparte in the original suit.
Now the question is : Whether under these facts and circumstances,(upon restoration of the suit ) it is necessary to again issue notices/summons to the present surviving L/Rs of the deceased defendants and 2 original defendants who were arleady set exprte in the original suit and also in the mis-case.
Kindly give some Citations preferably from the Hon Supreme Court of India on this issue.
