I am employee of a Bank. In our bank sealed cover procedure is adopted in the cases of promotions if any inquiry is pending against employee or sealed cover promotions are cancelled if the employee is awarded penalty. I was once selected for promotions but it was kept in sealed cover due to on going domestic inquiry against me, and it was cancelled after penalty imposed upon me. I participated in next promotional process and again it was kept in sealed cover. Latest on 13.12.2012 in the meeting of board of directors my promotion was again cancelled on the basis of previous penalty on which my earlier promotion was cancelled. Penalty once and cancellation twice. I have come to know that the Chairman of the bank mislead the facts before the board with intention to get cancelled my promotion through the board and he is successful by disguising my earlier cancellation. What should I do ? Can I lodge an F.I.R. against Chairman for conspiracy against me with intention to harm me under IPC ?

how would be the partition to be done under hindu succession act? what will be share of each? Do daughters have equal rights after ammendment of 2005 in section 6?
there is doubt as son is co parcener by birth but partion is demanded by him after 2005. so does daughter can get equal share?

In our society there are few closed parking spaces bought by members from the developers earlier and there is open space where members are also parking there vehicles. Now a days the no. of cars have been increased and we are finding that the open space is also not sufficient for the parking. One of the suggestion given by some members is to dis-allow tenants in the society to park their vehicles in the open space (i.e. common area) of the society (NOT in closed parking bought by the members earlier).
Question -
If General Body or Managing Committee creates this resolution, can this be implemented ? Is this legal ?

Hello,
My Friends Grandfather had mortgaged a property in they year 1960 and it was registered. The condition was that the papers too had to be kept in the possession. Later the payment had been cleared and the papers were handed over to my grandfather. Thereafter he passed away leaving behind four legal decedents who were unaware of the cancellation of the mortgage. Now in the search report it shows that the property is mortgaged. The other party i.e. mortgagee is not available has left the country and is not traceable. All the papers including the original mortgage deed is in possession of the legal decedents.
Can you please advise me as what can be done to cancel the mortgage as it has even crossed the limitation period. Where have I to apply to cancel the registration of the mortgage?
Thanking you in advance.

recently apex court has held that the mp and mla can continue their practice as advocate during their tenure as MP and MLA. Can any one provide me the citation of the judgment. I am needing it urgently. news items in the internet shown is od dated 25/03/2012.
please help.
My client wants to apply for GC.
She will be filing 130 / 485.
Her DOB on school leaving, passport is 23rd Oct 1946.
Her DOB on BC [which she never had, but when checked in town municipal corporation, found same as surprise] is 23rd July 1946. The authority issued BC depending on the available record. We could not deny the BC.
How can this be rectified?
Should she change DOB on PP? This is hectic and horribly long process which may go in further discrepancies.
Municipal Authority are not ready to give anything in writing for DOB on PP. They say that they have already issued one BC of record that they have.
Please guide. My client being widow and only son [his naturalization done] in USA is desperate to go to him.
Changing dob on PP is not going to work as system keeps showing change in DOB and GC authorities do not accept it easily and keep proposals pending as we heard.
Can Non availability of certificate for date of 23rd Oct 1946 be obtained if one record of 23rd July 1946 is already found and issued?
Municipal authorities are totally adamant on this issue and say no, perhaps they are creating need for negotiations.
I wanted to know if other municipal corporations authorities do offer such certificate in Maharashtra or India so that I can carry same format.
I wanted to know if other municipal corporations authorities do offer such certificate in Maharashtra or India so that I can carry same format. Also if Non availability of Birth Certificate can be issued in this matter? Will discrepancy of dates be entered in Non Availability of Birth Certificate? Please guide.
correction or amendment of pleadings
whether a correction of typographical error, can be made in the pleading, which does not change the nature of the case, after the decree passed?
