hi everybody,
i want to know whether a bye law of an cricket association recommends arbitration clause in case of dispute.
i have filed a suit for declaration for suspending my client from the association for 3 years and i have filed the suit inspite of the fact that there is a clause in the bye law which says that the aggrieved party should ask for arbitration.
now the respondent has filed a petition u/s. 8 of the Arbitration and Reconciliation act asking the court to initiate arbitration clause.
whether it is necessary to go for arbitration other than going to the civil court for remedy

Respected Experts,
I had filed a Partition Suit on my father's property and fighting the same case since 2004. It has come to the final stage as my PW1 is over and argument will commence next week. Meanwhile, my advocate has betrayed me by being biased towards the opponent party in-spite of paying for the entire case. He has now given NOC too. Since due to my financial constraints again to hire the service of another counsel is difficult at stage. Hence kindly tell me if I can appear personally without any counsel's assistance by submitting written statements for the despondent's arguments.
Kindly advice. Thanking you in anticipation.
Your's sincerely,
Yashodha

land acquisition 4(1) notification 1978. subsequent govt decides not to proceed with acquisition. a GO passed in 1982 that no acquisition of the same. but this GO kept secret. total extent of land brought under acquisition was around 100 acres. subsequently as the said purpose was dropped the lands were re conveyed excepting a small piece of land around an acre. several people claimed. matter went to supreme court. in 2011 the SC allowed the respective body to re convey the said land to interested person as and when the govt dept wish. note that the 1982 GO was not brought to the knowledge of SC. inquiry held by DRO revenue dept. order passed by DRO revenue dept recommending re conveyance to a particular person who was not at all a party and never ever claimed the said property. clearly vested interest exits with the officials. other person take steps to challenge. the govt officials put all sorts of obstacles to the genuine claimant. even the DRO order copy is suppressed. when the respective genuine owner take serious steps the respective dept take a U turn send a communication that they are not proposing to re convey the said land and that they are planing to bring another new project on that small piece of land. what is the legal position of the govt?, whether the stand of the govt is legal?, what is the remedy available for the genuine owner?. another important fact is that the same govt body in 2007 passed order recommending re conveyance of the same property to another fraudulent claimant colluding with him. only publishing gazette notification was pending. at the last final stage fearing serious repercussion the matter was stopped. in the said order also the respective govt body clearly stated that they are not willing to continue with the acquisition of the said land. that they are not willing to retain the said land.

If the Learned Judge will not follow the HIGH COURT or APEX COURT judgment and Learned judge passed illegal judgment against the judgement of Hon'ble The Chief Of Justice Jharkhand already passed judgment for same suit premises , then how can I file a petition to the HIGH COURT CHIEF JUSTICE for necassary action as per RULE of LAW. Is there any proforma regarding complaint petition?? I have valid proof and evidence,,, the case was remanded back by 1st additional judge to learned judge and 1st additional judge ordered him to consider his points,,, but learned judge judgment was so illegal that he neglected four judges judgment including the judgment of Hon'ble The Chief Of Justice Jharkhand,,,
illegal judgment promotes criminality in person who got favoured...by the judgment....I am suffering ,, now he came into criminal activity...
I have sufficient proof so prove learned judge judgment is illegal and full of corruptio...

Sir/Madam, there is a case in which decision is against the tenant in Small Cause Court. Tenant appeals in District Court. Owner intentionally makes false applications to the court stating that tenant has given the said property a sub tenant & further landlord prays to vacate the suit property.
For the purpose of evidence, tenant has sent a third person to have chat with owner along with the spy pen recording camera. In that discussion, the owner accepts the fact that there is no sub-tenancy. In fact he says that the person is the servant of tenant.
Tenant submits the Muster Book & C.D. in which such discussion is recorded But District Judge has not considered the said proof & kept the application pending for year. When the paper book was made, tenant demands to consider C.D. as an evidence, but Judge denies the same. What should be done in such case? and whether such recording by spy pen is admissible evidence or not? Please cite the authorities if any.

Cancelling exparte
Respected Sirs,
Recently Mr.A came to know that an exparte eviction decree[house rent case] has been passed against him and his brother after the death of his mother[died 3-4 years back] showing Mr.A as resident of petition premises and LR of his mother. Mr. A was not yet all tenant independently or under his mother. Mr.A was not yet all resided in the petition premises but during the life time of his mother address of petition premises wrongly reflected in some of their correspondence etc. In fact Mr.A residing in different city. One of his brother who is also not residing in the petition premises has contested the case. But court ordered Mr.A along with his brothers to hand over the possession. Mr.A was not aware of any such proceedings till few days back. Mr.A was not been served with any notice till now. Now the alleged land lord filed execution case against Mr.A and other brothers. What steps can be taken by Mr.A in order to get rid of binding of eviction decree on him which was passed at his back.
