Dear sir
I may met wall issue from my neighbor. Rcently i brought the old property & trying to construct new one. the neighbor 90% scratched away his own wall. his building is standing on my wall. now he is apposing to remove my wall & block mailing as "if you try to remove your wall, i will go to court. After judgment, you can build you'rs".
As per my lawer's advice i filed caveat in munship court, sub court, district court. Also he suggested to file in high court too. I agree to do it.
my questine is,
1)If I filed caveat against one party. Is it possible to get stay from his brother or son or wife or any thrid party of opponent ?
2)Eventhogh lawer given the file number, How to know the lawer is filed the caveat or not ?
3)Any other way to break my caveat ?
4)Lawer told as "once caveat filed court will send you the notice before making any action for this particular property until 90 days" is it correct ?
5)During the 90 days can we finish our building work ?
Please Guide me. I am very very disappointed regarding this issue . Please . . .

Sir,
My friend had issued Public Notice on order of court in probate petition.
There is no opposition has been filed yet.
the problem is that there are two executor and in their names there is mistake in middle name of the petitioner in beginning part of the Public notice. One of the para of the notice the true names has been written.
The question is that such public notice become void? no one knows the error even the advocate came in knowledge of such error after one month issuing such notice...
is corrigendum must?
please guide my advocate friend...

2) my father didnot write a will for the property(house and land) which is in his name. now i want to change these property to my mothers name. myself, brother and 2 sisters are the legal heirs will agree to do so. Then what is the process for me to do it legal by law. can i know it in detail process to do.

1. What is the difference between all these three certificates and in what and which conditions or circumstances these are fit to use?
2. After death of a government servant his family is given certain post death benefits please advise which is the appropriate certificate to claim each or all benefits separately.
3. Succession Certificate - Is SC can only be used to claim immovable property or The post death payments or benefits (of govt employee as GPF, Gratuity, Ex gratia, GIS, DLI AND Family pension etc) are also released on the basis of succession certificate or legal heir or dependent certificate?
4. If a son is debarred by his both parents can they claim these benefits being his parents or successors after the death against his minor son and surviving widow wife.

Dear Sirs,
In the year 1997, our joint family property was partitioned through the compromise decree of court. All the parties were given possessions of their respective shares at the time of filing compromise and this fact is mentioned in decree. All the parties are in possession of their shares since then. There were no execution proceedings since all the parties were given possessions. The decree is not posted in 7/12 of the revenue records till date. Now one of the parties is saying the partition as per the compromise decree is not acceptable to him. Does this decree provide enough protection to us? Is the decree valid? Can we get the 7/12 altered as per the decree now?

I HAVE THREE QUERIES:-
1)Whether a plaintiff can ask a person to depose as plaintiff witness when his name is not listed in the list given under Rule 1 Order 16 CPC, and without preferring an application under Rule 1(3) of O 16.
2) Whether such person/witness as above can depose before the list of witness given by the plaintiff is completed.
3) Whether an application under O 16 Rule 1(3) can be preferred by the plaintiff when the deposition of witness from the plaintiff side is going on, on the ground that the person whom the plaintiff wants to depose as witness is an old and ailing man.

A civil suit has already been filed for eviction and recovery of arrears of rent. The defendant entered appearance and has filed application to refer the matter for arbitration since the lease deed has a clause in that. He has not yet filed the Written Statement and during the course of transact he has admitted the claim against him. As i know the case can be referred to arbitration as per the clause. But, what exactly i want to know is when the defendant has admitted the claim against him and has undertaken to vacate (NOT SURE WHEN) can we continue the proceedings in the civil court? Are there any recent H.C & S.C citations.
Sir/Mam
What is "Living Will"? is it permissible in India?

Maintenance
Please advice me when a mother can claim maintenance from her earning sons?
Under DV ACT a mother is claiming the maintenance and later on she files the criminal complaints. In this case a mother is still eligible for maintenance? If yes, why?
