I'm fighting civil case, i have brought fraud/false/misleading information before Hon'ble court given on oath/affidavit. Perjury had been filed boz of that. Opponent had given "no say" on Perjury proceeding. Thereafter, Perjury proceeding had been in cold storage. Written order of Hon'ble Judge sayig that "Jr. advocate states that he has no say for perjury". Hon'ble court is reluctant to initiate criminal proceedings now and i'm getting tarik -pe-tarik.
Someone had suggested me to file application under order 8 rule 2.
What impact it will have? and what will be action on perjury application ?

I have a civil case and hired a lawyer. It is not working out. I need to get another lawyer. I understand that the earlier lawyer has to sign no objection certificate.
I have contacted mutliple times and he says he will provide it. It has been six months. I still hasn't got it.
No dues pending etc.
What are my options.I need to get another lawyer and take my case forward
Thanks in advance.

Sir,
I am pursuing my partition case since last 18 years Supreme Court of India already confirmed partition decree passed in my favour by the Hon'ble High Court AND ATTAINED JUDICIAL FINALITY AND STILL CONTINUING in Trial Court for final decree.I am having the share in the property only on paper and I am still pursuing the vexatious litigation between myself and my sister. My sister and her husband is occupying the land and is trying every possible trick to checkmate me for filing final decree proceedings. I am being obstructed from getting my share in the property by vexatious litigation. My sister, her husband and her daughter is a master in court matters. She even gone to the extent of eliminating my life in the court premises. Whether I should abandon my claim or fight for my claim I am confused. Whether I should believe in GOD or Constitution to get my share.
Please suggest me what are the available possible remedy for litigants prolonging my case. Is there any penalty for wrong and false litigants and pleas under the Indian Laws.
Thank You

I am probating my father’s last WILL and TESTAMENT in district court. The summons to all the legal heirs has been served by the court. In this regards i have following question
• Do they get the copy of the will along with my application before they submit their say?
I fear that one of them will produce a false WILL based on the contents of the WILL which is in for probate
What is the meaning of receipt of payment of the state duty (on the basis of a court decision)require for registration of divorce? Is registration of divorce obligatory in our country?
Information is required in connection with divorce of a person staying in Kerala.

sir,
i am in problem with my own plot kindly help me please.
1. i am having one plot near god siva temple, which is coming under the archaeological dept regulated area (the distance map taken from google map to find the 100mtrs or above)
2. my plot distance starting from the siva temple 101 mtrs and the end with the 140mtrs.
3. now i am planing to construct a flat nearly 5 houses in that place
4. but the local area people and flat promoter's are informed that the NOC is not available from the archaeological department.
5. If the NOC is difficult to get from the above said dept, can we demand the guideline value for my plot area as per the Tamilnadu government rate.
6. either they have to give the approval to construct a house or flat if they not interested let them give the money as compensation for the place.

My Grandmother had one share in undivided Hindu joint property (not partitioned).. She bequeath her share through WILL to her daughter in year 1999 (before Amended Hindu succesation ACT 2005) and she passed away in year 2011.
My question is my grandmother being a member of Hindu undivided family .. Can she bequeath her coparcener interest by making WILL?
Addagada_Raghavamma_And_Anr_vs_Addagada_Chenchamma_And_Anr_on_9_April,_1963
The above Supreme court citation supports that "member of Hindu undivided family cannot bequeath her coparcener interest by making WILL"
Is this latest still?

Sir, we are three brothers and one unmarried sister. My sister died unmarried in the year 2010. Therefore one of my brother filed an application for succession of her bank balance (nearly 17 lakhs ) in which he is applicant and myself, our other brother as respondent (opponent). But in his application, he has clearly mentioned that we three brothers are her legal heirs and successor to her property( as our mother & father also expired before her death). But from last year in month of September 2012, my applicant brother (who filed the case) went to U.S. for two years for official work and will be returning to India end of 2014. As my applicant brother is absent from last six months, the said case is not proceeding further. Therefore Hon’ judge said case will be dismissed on next date. We tried to contact our applicant brother, but he is not responding neither he is ready to give NOC so that we can proceed further in the case. The case is on evidence and cross stage.
Sir, my question is in above condition how to proceed further or whether case will be dismissed and we will have to file new application for succession. We are staying in Pune, Maharashtra.
Executed sale deed and will for the undivided joint property
Person 'A' executed the WILL for the undivided joint property in the year 1999. In the year 2004 person 'A' executed the sale deed for half portion of the joint property (without partition deed done before).
Person 'A' passed away in year 2011
My question is . Does person 'A'... need not to be cancel her WILL before the sale execution in year 2004?
Is that Will document still valid?
