Hello Sir/Madam, I wanted to ask one question..it would be kind of u to answer.. Is society noc required or compulsory while giving your premises on leave and license basis ? Can you inform them later after leasing the property..? so that you can pay noc to the society..
Thank you..
I have filed a consumer case on behalf of my client. The case of my client is he had paid the 1st premium amount of Rs. 50,000 on 22.01.2009, then paid the second premium amount of Rs. 50,000/- through the credit card on 22.01.2010 but the second premium amount has not credited in his policy account, on the other hand the Insurance company asked him to pay the said amount and told him that the policy will be lapsed if he will not pay the said amount. My client repeated explaned about the payment but till May 2012 they forced and tortured him to pay. But subsequently after May 2012, their policy account shown that 50000 credited into his account. In between this my client became vexed and asked them to surender the policy and refund his amount. But they said that they could surrender the policy only after 3 years as per the policy conditions. But my client don't want to continue the policy because of their insufficient service and torture. Hence he didn't pay the premium for 2011 and 2012. Whether my client could succeed in this case for getting the refund amount with compensation of Rs. 2,00,000/-. Please kindly suggest me to proceed this case. Now i am the stage of filing the proof affidavit. What kind of defense can be taken by my client to succeed this case.
Can we claim a fixed amount of compensation in summary suit alongwith the invoice amount and interest thereon.

In a suit for partition, 1 plaintiff, 8 defendants... D3 to D8 set exparte... D1 & D2 submitted written statements... on the same day D2 filed petition for rejection of plaint under O VII R 11..
in the next hearing, plaintiff filed COUNTER AGINST I.A and prayed for dismissal of I.A... court fixed date for arguments... on the hearing day... Resp/ Plaintiff expressed to court that he is ready for enquiry /arguments WHEREAS D2 PRAYED FOR DATE...just to drag/delay....
1. As it is I.A in main suit, like this how many times court will give dates inspite resp/ plaintiff is ready....
2. Can plaintiff file his written arguments irrespective of arguments of petitioner/D2
in the next hearing?
3.any other views/suggestions

Revision petition in ncdrc
I had won a case at cdrf and filed the necessary execution petition during may 2012.
however the OP filed an appeal at the state forum and got a stay.
the state forum has now dismissed the appeal allowing me a cost of 5000rs too.
the execution petition filed in cdrf was posted on 30/4/2013.
on that day the OP appeared and stated that they had filed a "Revision Petition" at NCDR.however no documentary evidence was produced regarding the forum.I have also not got any notice from the NCDRC regarding the same. as such the cdrf advised me to take necessary steps for issuing show cause notice.what are those steps needed from me at this stage? if possible kindly give a format of show cause notice in this regard.
1)do I have to appear before the NCDRC?If so,will I be getting an official notification from the NC for the RP?
2)is the revision petition means "appeal"? or is there any difference?
4)Is the procedures as a respondent same as in the appeal at state forum?i.e do I have to submit an argument note etc? or the case file from the lower court will be called and based on the same only a relook by the national forum?
any further guidelines on the technical/procedure aspect would be of immense help to me.
