Sirs,
Please clarify me as to how the liquidated damages are calculated, what components are considered for arriving at the liquidated damages by the employer in case of breach of service agreement for higher education purpose. The said Service Agreement is not signed by the employer and copy thereof was not furnished to the employee and also does not contain notice period for resignation. The resignation letter submitted by the employee was ambiguously replied quoting the Bond of 3 years, whereas the leftover service for 3 years is less than 5 months, and referring the notice period. The job profile is highly fetching for the company on account of the works/projects of foreign clients. The billing from foreign clients is claimed in multiples and multiples of the salary package of the employee.
Any remedial acts within any of the constitutional provisions may please be provided. I note to contact even personally for any remedial acts suggested.
With regards,
R Vijaya Kumar

Respected Sir,
I am vacating my rented house on 2nd June and i have already provided a verbal notice to my Landlord a month ago.
I have been following up with my landlord on the security deposit of Rs.50,000 , but he seems to be either evading or dilly dailiing by sometimes telling me that he would provide cheque and sometimes he says he would provide cash only after i handover the keys on June 2nd 2013.The queries i have are as below
1) Can i accept cheque on the last day after handing over the keys. What would happen if the cheque gets bounced. Can i go to the court against him.
2) Cash on last day should be fine according to me. But can someone point out the legalities if i accept the security deposit by Cash.
3) What is legally correct way to accept the sceurity deposit.
Thanks
John

Under the Hindu Succession (Amendment) Act, 2005, the daughters are entitled to equal inheritance rights along with other male siblings, which was not available to them prior to the amendment. The new Section 6 provides for parity of rights in the coparcenary property among male and female members of a joint Hindu family on and from September 9, 2005. What laws apply to rights of women in joint Hindu family before September 9,2005?
The property is ancestral and there is no will.

Dear Sir/Madam,
I have decided to buy land, but the developer is not ready to give documents for legal verification unless I book the property by issuing posted date cheque.
Now my question is can we make conditional payment of the cheque by making an agreement so that if the legal verification says problems in property I can cancel my cheque. Something like this
" Both parties have mutually agreed that, unless the buyer(second party) gets legal clearance of the proposed land, the seller (first party) will not clear the cheque" ?

A constructed a property in 1960 out of his own funds
In 1990 A made a will in favor of his son B.
B is only child of A Class 1 legal heir.
A died in late 90’s.
B become the owner of property though will.
B has 1Girl child “C” and 1 Boy “D”.
C got married in late 90’s.
B didn’t partition the property.
C as a girl child claimed her right under Hindu Succession Act 2005 from B.
Is C entitle for her right in A property before B death .
