Major repair fund

Ours ia 90 members society with 25 shops of average 200 sq. ft. area and remaining residential flats with average 500 sq. ft. area. The managing committee did not pay heed to maintenance of the building for last 10 years and now the society is served with two notices from B.M.C. stating building is in dilapidated condition and need urgent repairs.
The committee has asked each member to pay 45000 in two equal installments as an emergency repair fund.
Being a shop owner I felt this repair amount share should be calculated areawise. Means the shop owner occupying less area will shell out less money and residential flat owners occupying large area will shell out more contribution.
This is what I read in cluse 13 (E) (B) in new model bye laws of the society. Our society has not yet adopted the new bye laws. I asked for explanation from society about the how the figure of contribution is calculated and why not it is calculated on area basis as per clause 13. But my 30 days old letter is not yet answered.

The question is in all the above circumstances is my stand of "calculating share of each member of major repairs on area occupied by that member basis" valid?

Notice to vacate to tenant

Hi,

I am staying in a Paying Guest accommodation in Noida for the past 15 days. The person operating the PG (who is not the owner of the building which is used as a PG) asked me to shift to a different building today, also operated as a PG by her. I refused for personal reasons (small room, far from the main road etc). After trying to convince me for some time, she asked me to vacate the PG within a week as I was firmly refusing to make the shift.

I think 1 week notice for vacating a rented place is not right. Shouldn't it be something more appropriate like 1 month? Surely there should be a law defining this duration?

I do not have any agreement with her. I paid 1 month security/advance and 1 month rent when I started staying here

Orders

Plaintiff filed a civil case against the defendant, who was issued summons to appear on 14.3.2013 before the court. However, the court did not function on that day. The Defendant did not appear on that day i.e. 14.3.2013 and the Plaintiff, who was present, was given 30.5.2013 as the next date by the court staff . However, on 30.5.2013 also court did not function. Again, the Defendant did not appear and the Plaintiff, who appeared was given next date as 2.7.2013 by the court staff. Now questions are

(a) How the Defendant will come to know the date of 2.7.2013 when he did not appear on 14.3.2013 and 30.5.2013.

(b) If the Defendant does not appear on 2.7.2013 also, what action can be taken by the Court in this Civil case.
