Declaratory suit & execution order

In the above mentioned Declaratory Suit, the Senior Civil Judge had passed Judgment & Decree in favour of the Plaintiff, subsequently the Plaintiff had file an application for execution of Decree in the court of the same Senior Civil Judge for Eviction of the Mortgage land. Application was granted and the Execution order was passed.

The Decree-Holder, without exercising the execution order passed by the court in his favour had preferred an agreement with the Judgment-Debtor. Now in their agreement, the Decree-Holder had guaranteed that the mortgage land in the suit will not be evicted or sold to anyone. The decree-holder had also agreed to wait for payment which will be made in lieu of the said mortgage land by the judgment-debtor without any given time frame. The decree-holder in the agreement had also promised to the judgment-debtor that he will not file any suit, application for eviction in the court against the judgment-debtor.

The agreement was registered properly and notarised and produced in the aforesaid court of senior civil judge. The court had examined the agreement of the both parties and had disposed off the case.

Now, the decree-holder had file another application for restoration of execution order in another court of senior civil judge.

My humble question before the law experts of the LawyerclubIndia is, how the decree-holder application for restoration of the execution would be restored whereas they have already entered into the agreement and the earlier execution order was disposed off by the court of senior civil judge. More particularly, the judgment debtor had stand faithful in each and every terms of the agreement with the aforesaid decree holder, and there was no default from the judgment debtor side.

Your precious advice and guideline will be highly appreciated

Noise and sound pollution

Respected Experts, I purchased a flat two months back, which is a corner upper ground floor flat. As the flat is on the opposite side of the road, therefore, there is a 25 Ft. empty space left by the builder between boundry wall and the flats facing the boundry wall and the balconies of these flats face this empty space or green belt for only fresh air inlet-outlet. but now the president of the society has ordered two 125 KVA gen sets installed on this empty space. which are within 20 ft from my bedrooms and 15 ft from balcony. the exhausts are facing my bedrooms. the president of the society says that this land is common land and can be utilised for public purposes, whereas, i think the place falls under limited common land as per the punjab property and apartment rules 1995. even otherwise, the gen sets are used for street lighting and other public utilities and are on when there is power cut, as such, i can't sleep in my own house due to noise and it is also hazardous due to air pollution with diesel combustion.
please suggest what legal options I have. I have reported the matter to SDM, MC, Pollution control board, Forest dept for illegally cutting of trees from this space etc. but I know there shall be no action on complaints as usual because this is punjab.
hence, I want to move to the Hon'ble High Court, but prior to that I want to be fully armed with the legal provisions and know my legal rights. please guide me.

thanks,
samra

My wife's sudden departure to father's house and no sign of return

My wife suddennly departed to her parents place along with all her belongings, ornaments and my daughter on 01/04/2013 following an acute wrangle and hot arguments with me on 31/03/2013. She left my house when i was in office.I have intimated the case to the local police station. In April and May i have sent her rs 8000/- per month through money order and that she has accepted. i have tried my best to persuade her by my self, by well wishers and mediators etc. but she has refused to come. As per ajoy sir , i wrote her letter also which she did not reply. She is asking for a mutual divorce at the cost of 30 lac or she can come back if i purchase a flat. both the things i denied as per the advices from the experts like ajoy sir, ravinder sir and others. However my wife is not interested to return. should i keep on sending her money and if so for how long.
She has not filed any case against me till now.if i stop giving her money and force her to file case against me should i get advantage as a defendant. please advice.
