suit for recovery of money decreed as prayed, decree holder filed execution application for arrest of JD, JD has no means to pay the decree amount and he Filed insolvency application before another court. What relief entitled to JD (judgement Debtor)? how can Decree holder arrest the JD without means?

In a suit before the Civil Court, cause of action for which suit was filed has changed. The stage of the case is that it is fixed for Plaintiff's evidence in september, 2013.
Kindly advise how cause of action should be changed and what type of application should be filed in the court.

Hello! respected members. I am going to file an application for succession certificate in the name of a wife. so please guide me if there is any G.R. or notification in regard of exemption from court fees for women and children litigants. The Applicant is domicile of State of Maharashtra.

After A death should his LRs be impleaded in the respective appeal in which the properties were given as security?. And then the LR may move a petition seeking the permission of the court to sell the properties?. In such instance who should execute the sale deeds?. whether the LR in their individual capacity execute the sale deeds?,Of course with the permission of the court. or will the court itself execute the sale deeds? in such instance should consent of the LRs required?.

we have bought a land 10 years ago and constructed compound wall 9.5 years ago,3 years ago we constructed a house inside the compound wall, while constructing my house, my neighbours lodged a case in court that his 2 feet land is inside of my compound wall,before lodged a case in court, they measured my land by government surveyor,he told my compound wall is constructed correct,now we need to rise my compound wall,because it"s height is low,he can jump to my house through that wall, so it is not safe to my house,is it possible to rise my compound wall through police protection because if we start to rise my wall he started to damage my wall,even if we start a construction work after two feet,for that also he is threatening and restricting by damaging my compound wall and we don"t know what is the status of the case, only vaitha is going ,so please tell me how to rise my compound wall immediately?

Can one initiate Arbitration process unilaterally If there is a MoU mentioning the arbitration clause and other parties to it refuse to go for arbitration ?
Which is better forum for arbitration as a friend has suggested Bombay Chamber of Commerce, Mumbai. Pl suggest alternate options in Mumbai.

I am defendant want to file out of order petition [party in person],in civil suit,
1- should i give notice to plaintiffs advocate.
2- how to give notice to the opp. party.
3- should i mention all the facts intended
in the petition.
4- is it like regular application filed in court.
5- will the court decide the petiton on same day of filing the petition.

Caste determination & procedure to change the caste with that of my father.
Hi, Im vennila. The question is my father is of Scheduled caste & all his official & school records bears the same. But both my parents expired in a fire accident 19 years back. Before their death we were staying in one of his friend's place because of poverty and while joining us in school, his friend has mentioned in our school as christian. Now im working in a State Govt. since 15 yrs. I didnot know that my father belonged to SC. In all my school records & office it is mentioned as christian. Recently, when we shifted our house, i got a certificate of my father in that it his caste is mentioned as SC. Now, I want myself to be changed to SC since my father and also my husband is an SC. What are the steps/procedures to be taken for this. Please help me. Thnks.
