Debts payment

I lost around 40 lakh in the business. I took hand loans from 3 to 4 people for different amount. Since last one year I was unable to pay them any interest or principal. I got the job recently. I told them that I am selling my house for 20 lakhs (out of which 10 lakhs will go as loan to bank and I get only 10 lakhs in hand). Out of this amount I will clear some amounts to them. Inspite of this they are coming to my house daily and harassing me to either sell house for 15 lakhs or give back all the money. I am just settling down with financial crises. I will surely sell my house but the market value is around 22 lakhs but ready to sell even for 20 lakhs. Please advice how to get rid of financiers because I wont be able to clear entire money. Regards Vinodh

Eviction notice to flat onwer

I am living in a apartment with 32 flats. There was one secretary holding position for last 7 years. There is no formal association functioning since 7 years expect registration document. Due to his erratic behaviour all the owners revolted against him and called for election and a formal body was formed. He went to court and filed case against the association that the election is illegal. The new association has filed the counter. But his behaviour is very odd and inconvenient to the residents. No body is in favour and he is living in isolation and frequently sending legal notices for every thing. The association told him to vacate his flat if he has problem with the residents. He mentioned that he is the owner and nobody has right to evict him. Kindly advise in this matter. Regards Vinodh

Ia-oral submission by client

Sir, (IA)
There are 3 respondents and an appellant.Appellant files IA for submission of certain documents. Resp. No. 1, is Municipality. R2 is complainant, asking R1 the Municipality for demolition of unauthorized construction by Appellant.Appellant raises objection to the qualification of Executive Engineer. In support of this contention Appellant files certain documents which are not of much relevance. In absence of his counsel the R2 by oversight/unknowingly on asking by the Judge, submits, "It is Municipality who has to submit supporting documents and prove.(R1's Counsel was present). Therefore my Counsel who was to come was saying that, he has no objection for the same." The Judge notes it down mostly on order /office sheet as "no objection by R2". R2 waits re-submits that, the same remark and noting may please be reconsidered as he does not know, whether it will affect the case adversely.
Please inform as to what is the effect of the above noting/submission and suggested way out of it. The matter is posted for tomorrow.
Regards.

Disconnection of electric & water supply

I am a tenant of a Landlord at a housing society at lucknow. The society maintenance is being under ARMY WELFARE & MAINTENANCE SOCIETY REGD UNDER SOCIETY ACT 21 of 1860. My electric connection is directly from the Govt Electric Supply.

I have been asked to deposit Rs 4000/- one time non-refundable deposit for a temporary membership (beside monthly maintenance charges) by the Society just being a tenant whereas my landlord is a permanent member of the society.

1. Can it be made mandatory to have a temporary membership? To my view it cannot be.

2. Can the society has the jurisdiction to disconnect my electricity and water in an event of non-payment of the temporary membership dues?

3. Can the society charge maintenance one year in advance.

It pertinent to mention here that i have deposited whole year of maintenance chrge in advance.
