Lrnd. Experts,
My father is four brothers, and partition suit is going on. My father is defendant no-3. Due to his age he rarely moves. can I the youngest son depose on behalf of my father, or can he skip deposition and what will be the effect? How many witnesses are needed? What best can be done? Plz. advice. Thanks to all in advance.

I decided a representation By my order dt.15.01.07 in compliance of Hon'ble High court order dated 24.07.04
Govt. issued an order dt.27.02.09 quashing my above order dt.15.01.07
Agrieved party filed a w.p.no.1844/09 in High court.Hon'ble High court passed an order/judgement dt.15.05.09 and was pleased to quash the Govt. order dt.27.02.09 and directed o.p. no.1 Govt.to decide by reasoned order.in this order Hon'ble High court observed that Director(I)was well entitled to decide the representation as it was in compliance of High court order dt.24.07.04
Even though Govt. has charge sheeted me and the charge framed against me is that'I was not entitled to decide the issue.'
My queries are:
(1)Is it not contempt of court?
(2)in comliance of High court' order dt.15.05.09 Govt had decided the matter by order dt 21.07.09 quashing my order dt.15.01.07 but charge sheet against me was issued earlier on 08.06.09 by Govt.
(3)In another w.p.no.5241/09 Hon'ble High court has stayed Govt. order dt.21.07.09 and w.p. is pending.
(4)consiquently my order dt.15.01.07 is prevailing even though I am facing disciplinary proceeding on the above charge.
pl.suggest legal position and how should I
defend myself from above charge

Without filing suit for specific performance of contract, can Court grant relief of specific performance in a suit for injunction.

We remember that levy of service tax on ‘Rent’ was held ultra vires by Delhi High Court in case of Home Solution Retail India Ltd. Vs. UOI and others (2009) 20 STT 129. Union of India- who was the respondent in said judgment filed a SLP in Supreme Court, praying inter alia for stay of operation of Delhi High Court judgment. However, the Supreme Court did not stay the operation of Delhi High Court judgment, but issued notices to parties concerned to file their replies. During pendency of matter in Supreme Court, Revenue authorities instructed their field officers by way of Instructions dated 15thJuly 2009 to take necessary action to safeguard revenue by either pursuing the tax payer to pay up the service tax or resort to means under law. The Instructions issued on 15 July 2009 were challenged by SSIPL Retail Ltd. in a Writ petition filed before Delhi High Court who has taken strong objection to said Instructions and it was assured by Additional Solicitor General, appearing on behalf of the Union of India, that corrective steps will be taken to issue further instruction, in super session of earlier instructions, to not to demand service tax till such time Supreme Court decides the SLP.
We want one clarification that if it is applicable on the properties situated in other states.

What is the procedure to be followed by a Court while making inquiry under Order 32, Rule 15 of the CPC?
Execution of Decree of Mandatory Injunction
We have got a decree of mandatory injunction for Judgment Debtor to vacate a property.
However the Judgement Debtor died after passing of Decree.
Whether the Decree could be executed against the LR's of deceased Judgment Debtor ?
What should we do ?
