Sir,
One persion by fraud got sale deed of our property from my mother when i am minor on my behalf..Then she filed suit for cancellation of sale deed on my behalf. Then after attaing major,I did not do anything.My mother only fied case.it is more than 12 years, It is still in High court pending.
My asking is Sir,
1)Whther My mother can sell on my behalf my property when my father is alive.i.e Whther my mother can act as guardian when my father is alive.
2)When the dispute is alive ,after getting major what is the status of the sale contract.
3)When the case is filed and is pending,can I file suit for cancelling the sale deed after 20 years of the sale date.

In case a will is executed by the mother in favour of one son out of her 3 sons is it neccesary to make all sons as party or only the person wo is not evicting. is there any citation to support that non joinder of these parties is not a ground for dismissal of suit.

breach of agreement for service

A govt. department hires a person for driving and a contract has been executed between them. in contract the condition for termination is one month notice or one month salary in advance but when the department tried to terminate without following condition of contract than that person filed a suit for injunction and a interim order for not terminate him without following conditions of contract was passed by the court. In spite of the TI order the department terminated that person. Now what is relief for that person?

Caste Certificate issue

One of my friends family migrated from Orissa - (Sunabeda)to Andhra Pradesh (Vizianagaram ) 18 years ago. In orissa their caste was ST (Kondhu)but after their migration to AP they were certified as Kapu by AP MRO. In this regard, how they can get their original Caste Certificate as ST.

consumer case in NCDRC

Dear experts,
Happy Independence day.

is it required to be a registered lawyer in supreme court for filing a case in supreme court of India or else a independent person can file a case for in person to supreme court for NCDRC appeal,
please clarify.

pre-litigation credit card

hello sir,

my friend has used his credit cards and has been not well since the last year and out of job, and this is the reason not able to pay his dues, now he has got a pre-litigation notice, please tell what we can do, now he is getting back to normal and will be starting up with job soon, and he cannot pay the amount what they are asking him to pay, they have added a lot of interest also. please tell us what to do in this regards

Am I a consumer under the act?

I had paid the fees of my 'major' son towards a private management college out of my earning and the bank dd was also taken by me from my sb a/c.

in this case can I be considered as a consumer under the consumer act?

How to enforce Arbitration clause in Family Agreement?

I am pited against criminal minded family members who are not agreeing to arbitration as per MOU signed for Family Settlement for the estate of late father who expired intestate without a WILL ?

There is a untanable demand from one of the brother and his wife for Rs. 60 lacs and they are refusing to move ahead with an Application already made in High Court for Letter of Administration in January 2010 which requires some modifications or additional information to be given to the court. I am one of the three petitioner and suffering due to delay in the matter and had suggested arbitration to other legal heirs and the one demanding or trying to exort a huge sum from me. Pl. give your opinion to following queries:

1) How can I enforce Arbitration in their demand for Rs.60lacs up front ?

2) As it is in fact arm twisting and cheating act on their part so xcan I file police complaint against the brother and his wife ?

3) They have forced me and other legal heirs sign a modified MOU in Nov. 2009 where in very conveniently removed the arbitration clause which was there in the
initial Family Agreement.

4) Due to clause 3 above can I enforce arbtration for just and speedy solution in the matteras I can prove that there demand for Rs. 60 lacs is untanable.

5) The crooked brother is working with Dusche Bank so will it help if I tell the bank management about this ?

How to enforce civil court order under consent terms?

We are a couple and I am 65 yrs. a senior citizen. In August 2008 I have obtained an order from City Civil Court in Mumbai for the two ownership flats under consent terms wherein my four brothers / their familes were defendents. The families of two dead brothers are occupying the flats as on date. As per court order under consent terms I am 20% owner in the two flats and the flats should have been sold by now but so far I could not acted on their disposal as all legal heirs are required to sign the sale deed whenever it happens and most of them may not co operate with me.

My queries therefore are as under:

1) How do I enforce the court order ? I have so far only intimated the society that I am coowner of these flats with 20% share in them.

2) How can I claim my 20% share at market rate from the developers If the building in which these two flats are located go in for redevelopment ?

3) Can the defendants now challenge the City Civil Court order under any pretexts?

Pl. help and guide suitably as per provision of laws in the matter.
