Redemption of Mortgage?

Property was under mortgage from 1942.
Plaintiff filed a suit for redemption in the year 2000. Will the Limitation Act,963 apply or not?

Land Dispute

Dear Sir/Madam,

Basically i am from Bihar and by profession i am Senior Software Engineer. My Father was Central government employee and now he is retired. We have ancestral property in Saharsa, Bihar. After division my father got the land from his cousins and from last 30 years we have house on that land and we stay there also. All villagers and all our family members and relations know that land is ours. Since that was our ancestral property my father didn't do registry for that land.

Recently 5-6 months back one of my father cousin brother (my father used to trust him) illegally did registry on his name and one month back only my father got to know that he did like that. Now my father is trying to get all the papers.

Please suggest me what should we do in this matter and how we should proceed? That property is still belong to us only but may be in future my father cousin brother can claim and because we always don't stay there we want to clear this dispute. Please suggest me what should we do in this?

drt filing.

I had paid the prescribed fees for application before the drt, chennai in April and it was assigned a SR No.. My lawyer took back the application for correction. The bank failed to make the mandatory paper publication and we had not yet resubmitted the application taken back. Now, the bank issues a 'Fresh' 13(2) & 13(4). Can I include this new notice in the earlier drt application? Would the first application in April still be valid after having taken it back for correction and not submitted till date? Or should I make a new application?

Sir,

I am not a party to the suit which is filed by the one of the parties other than the family member for entering his name in the owner ship column in the RTC. the property as per the partition in the family property is came to my share. i am unknow of the facts of the case and they are not made us as a party to the suit before the DC. later we came to know the order been passed by the DC. know we want to appeal but our council is telling it is not possible under Karnataka land reforms act. kindly guide me.

Time barred debt.

In the year Nov. 2004, I took a agri-loan for purchase of a Tractor under the scheme for large farmers. I only paid three half yearly instalments ( last payment was in 2006 ). I was not able to make payments after that. In the year 2008, the state govt. announced a waiver scheme. Some of the people I know had their outstanding waived. I never heard from the Bank or even any demand or communication. Now, I receive a legal notice, out of the blues, stating that I have a subsisting debt, and that I purportedly executed a revival letter on the last date of Nov. 2007 and also in March 2010. This is a blatant lie as I had not issued any such letter. Now, the legal notice demands payment of entire sum or else they will publish my photo in the newspaper as defaulter. It has been four years since I last made payment or had any communication with the Bank. Even if my loan was not included in the waiver schemed, would not my debt be hit by limitations? Can the Bank threaten me with publication in the newspaper?

Grdianship and compensation claim and Succestion

If matter for gurdianship of Two minor Orphan childrn(age12& 7)is pending in court betwen paternal grandma & maternal uncle of childern.
Still Patrnal grandma Applied for compensation claim on behalf of children is that correct?
is paternal grandma by law of succestion will get compensation in death claim of mother of to orphan childern.I know for his son she will get as pr succesion. but in case of her Daughtr in law if both childern alive will she eligible in her proprty and claim along ith childern by law of succestion?

Presently i am having copy of Document received register office and all the original with POA AGENT. To file civil suit what is court fee we have to remit.what is calculation for fee. we are seeking true and correct accunts and money value not involved becuase what is profit or loss made by the Agent. He deloveloped flats with violation and with consent invested same area Plot no.681 bought purchased in the name x and x brother name worth of 120 lakhs present market value.The builder same for 694 and 681 and after 832 day Y has not settled my due and asked records of Builder agreement, BUilding plan copy, executed agreement between purchaser and builder. CAR PARKING MONEY ALSO COLLECTED BY CASH POA y. PLOT 694 DEVELOPED 5 FLATS AND 681 DEVELOPED 10 FLATS IN THE ENCUMUBANCE CERTIFICATE. He has released part payment from 694 and asked record Bank Statement,Purchase register of purchase of Steel, cement, Electrical items / woods and painting, Labour records /Builder Sales No and Sales Tax Return and Builder promoted 15 flats suppose to pay service No. and return copy, Income Tax return copy of X, Y and Builder, Agreement between Purchaser and Builder. x threteting having political influnce and he has completed both project and purchaser occupied possion. what is the proceduce i have to follow. Sale Deed payment and Builder payment made cheque by purchaser. Pl solve the problem.
