Recovery case

A person sold his share of undivided property to a Builder at 1/4th the going market rate thro' an Unregistered Agreement to Sell and gave possession of the portion with him to the builder.The builder gave him a set of photocopy of documents as GPA,SPA, POSSESSION LETTER,WILL etc. which he had got signed by the seller.

The builder then filed a suit for partition using these documents. The suit is pending in court.

After 3 years the builder filed a recovery suit against the Seller.The builder also gave up the portion in his possession to another heir hoping that he too would sell 3 other shares to him. But this did not happen.

Now the Seller is stuck in a Recovery case due to no fault of hi.

What should he do?

Are the photocopy of the documents he got from the builder valid in court. Can he file them as evidence ? Please advise.

Partition

Property in the hands of successors will be treated as self acquired one. Then how the coparceners claim partition of the ancestral property ?

Restoration of Insolvancy Petition

Sir,
My client has filed an Insolvancy Petition for 20,69,000/- against his creditiors and the same is posted for apperance and trial of the Respondents, unfortunately our Senior Civil Judge has dismissed the petition as the petitioner absent. Counsel fro the petitoner is not present. Petitoner did not file any affidavit. Hence petition is dismissed, NO costs. Judgement passed on 27.09.2010. The creditiors/Respondents are strong as politically and economically, if they come to know it would defeinetly harmful to my client. I want to restore the above IP to its original number. Whetehr it is order 9, Rule 9 of CPC or some other ? please inform the mode of restoration of above IP.

Suit

HI...

Can i file suit for property which is already disputed between my father and uncle...
the property belongs to my late grandfather...
Now, as a elder grandson i want my share in the property, the property is in my father`s possession and i live with my father only...

Regarding u/s 9 of Hindu Marriage Act

Sir(s),

The matter was settled between the parties before women's Cell & mutually separated. thereafter husband files application us 9 of HMA in UP. wife lives other state & wants neither appear in this matter nor proceeded ex-parte. Someone suggested file the memo of parties & appeared on the date with the statement that wife can't appear & file transfer application in SC.
Can explain about Memo of the parties & procedure.....

Tenant

Dear All Experts

my house gave rentel basis to a tenant at 2003, he gave the rental amount without fail give 6 months, after that he has not give any rental and also he has not vocate my house still to date 2010, we are complaint the police station, the tenant tell that we will vocate house with in three month but he never vocate the house and he (tenant) asked Rs 1lkhs for vocate the house otherwise we cann't vocate the house. what are the steps we will take for vocate the tenant from my house, what are the procedure we follow ?

Query for liquor prohibition case

Respected sir,
My name is Krish Mehta. I am a student from Jamnagar, Gujarat. As you may already know it otherwise let me tell you bout the topic on which a query i want to ask. It has been 50+ years for Gujarat as a dry state (where alcohol-liquour consuming, selling is legally banned). We the people of Gujarat are daily witnessing that this law is now not working at all. Just as it failed in America & other regions. Corruption is at its worst due to this policy. This policy is not working & people are drinking illicit chemicals in the name of alcohol!

Coming to the point, can i file a public interest petition to the high court of Gujarat or any other kind of case in order to challenge this policy? The rule was implemented by Government of Gujarat at the time of partition of Gujarat-Maharashtra(Mumbai state) & the act under the crime gets its name is Bombay Prohibition Act.

school management injunction order

Shri.Subramaniam has actively answered my query. thanks please read the following and give me opinion.
Sir, continuning my previous question on 20/10/2010 please note there is no trust or society by which school is functioning. It is aWILL only.
May I know the cost of obstention of Injunction order from Madurai bench of madras high court. Injunction order restraining school magt. till the disposal of suit(private aided school in tamil nadu.)
How much time will it take to obtain it.
And also if we opt for court receiver appointment what is the cost.
how much time will it take to pass interim order in this respect.

Alternatively can we opt for 53A of tamil nadu aided management school rules 1974,3.
then what is the procedure, what cost and what time.
please sir
